학생의 교육기본권과 부모의 교육권: 협력과 상충

국문 초록

부모의 교육권은 다른 기본권과는 달리, 기본권의 주체인 부모의 자기결정권이라는 의미에서 보장되는 자유가 아니라, 자녀의 보호와 인격발현을 위하여 부여되는 기본권이기 때문에 부모의 교육권 행사는 오직 자녀의 행복과 복리를 위하여 행사되어야 하며 부모의 교육권과 민법상 친권과의 관계를 검토하여 부모의 교육권과 민법상 친권은 모두 자녀의 이익을 가장 잘 보호할 수 있도록 행사되어야 한다. 학생의 교육기본권과 부모의 교육권은 서로 협력하여 교육의 목적을 달성 할 수도 있고 두 기본권이 충돌하여 법적 갈등을 발생시킬 수 있음을 검토 하였고 부모의 교육권은 학생의 교육권을 보장하고 자녀의 행복이란 관점에서 인정된 권리이기 때문에 이 문제를 기본권 상충 이론으로 해결하는 것보다 두 기본권간의 특수성을 파악하고 사안의 특수성을 고려하여 판단한다면 기본권 상충문제를 합리적으로 해결 할 수 있음을 알 수 있다. 또한, 두 기본권의 상충 사례들은 어떠한 경우라도 학생의 이익 또는 복리를 기준으로 판단하여 법적, 합리적으로 해결 하여야 하지만 일률적으로 학생의 실익의 측면에서 해결 할 것은 아니고 구체적 사례의 특수성을 파악하고 개별 사안마다 이익형량과 특정 교육권을 제한하는 것 중 학생의 실익을 더 크게 보장할 수 있는 방법으로 교육권 상충의 문제를 해결해야 한다.

영문 초록

Unlike other basic rights, education of parents is not the freedoms guaranteed in the sense of right of self-determination of parents, the subjects of basic rights, but a granted fundamental right for protection of children and manifest personality. So the Exercise of parental education should be exercised only for happiness and well-being of children. Reviewing the relation Parents `` educational rights the relationship with parental rights under civil law, parental education and parental rights under civil law should be exercised so that their child``s interest can be shielded best . We reviewed that fundamental rights education of students and education of parents can achieve the purpose of education in their cooperation and basic rights can cause legal conflicts by a collision. Education of parents ensures fundamental rights education of students and it is the rights recognized in terms of their children``s happiness. We can handle the problem with conflict theory in basic rights if we consider specificity and distinctiveness between two basic rights rather than solving the problem with conflict theory in basic rights, Also, the conflict cases of two basic rights must be resolved legally and rationally based on the students`` interests or welfare in any case. But conflict problems in Education rights must be solved not on the side of practical use of students in the same right but by way to ensure largely the practical use of student among ‘interesssenabwagung’ every individual case and restriction on specific education rights and they need to be figured out the distinctiveness in specific cases.
