교원 징계 사유 및 징계 처분과 교원 관련 특성 요인 분석 -○○도 사례를 중심으로-

국문 초록

이 연구는 교원에 대한 징계사유와 징계처분 및 비위 교원들의 특성(학교급별, 성별, 지역별, 직위별, 경력별) 과 이들 간의 관계를 분석하고, 교원 징계와 관련한 정책 제안을 목적으로 수행되었다. ○○도 교육청의 2개년 징계사건 233 건을 분석한 결과, 사건수의 절대적인 규모는 교원 특성별로 유·초등학교, 남자, 교사, 20년 이상 경력자일수록 크나, 교원특성별 모집단 수에 대비해서는 고등학교, 남자, 관리직(교장 교감 전문직), 20년 이상 경력자 일수록 비위 발생 비율이 높다. 징계사유별로는 음주, 성관련 비위 순으로 높다. 전체 사건 중 4대 비위 사건의 비율은 30.5%이며, 이 중 배제징계 처분을 받은 비율은 31.9%로 다른 사건의 배제징계 처분 비율에 비하여 23배 정도 높다. 이러한 분석을 기초로 다섯 가지의 정책 대안을 제안한다. 첫째, 교원 특성별로 직무연수의 내용을 특화한다. 둘째, 음주 등 생활 비위를 최소화시키는 노력이 필요하다. 셋째, 교사와 관리자 간의 징계양정에 균형을 이루어야 한다. 넷째, 징계처분으로 ``강등``제도를 활용할 필요가 있다. 다섯째, 교원징계 실태에 대한 정보공개의 확대가 필요하다.

영문 초록

This study is to analyze the relationships among disciplinary actions as odious behavior, punishments, and the types of teacher characteristics such as school class, sex, school region, career years, hierarchical position etc. and to make policy suggestions for the reduction of teacher`s odious behaviors. The results are shown, based on the 2-year data of 233 cases of ○○Province Education Office. In the numbers of cases, primary school, male, above 20 years career, and teaching personnel in each type of teacher characteristics are the highest types. However, in the ratio to the total population of each teacher characteristic type, the highests are high school, male, managing personnel(principal, vice principal, supervisor), above 20 years career. The higher frequencies among odious behaviors are drunken driving, sexual violence in turn. The 4 big odious behaviors is amount to 30.5% to total cases. And, exclusion punishments, expulsion and dismissal, is amount to 10.7%. Based on the analysis results, five policy alternatives are proposed. 1. The contents of teachers` on-the-job training should be specialized based on the types of teacher characteristics. 2. Daily life crime such as drunken driving should be targeted to reduce, on special purpose, the occurrence ratio. 3. The levels of punishment should be balanced between teaching personnel and managing ones. 4. ``Demote`` should be considered to be implemented as punishment. 5. The information about teacher punishments should be opened more to the researchers.
