서해 북방한계선의 ‘정당성’ 논의 재검토

국문 초록

작년 4월 27일 판문점 선언과 9월 19일 남북군사합의서는 서해 북방한계선 (Northern Limit Line) 일대에 평화수역을 만들기로 남북이 합의하였음을 밝혔다. 하지만 서해 평화수역 조성이 범국민적 합의를 바탕으로 추진되고 있는 것은 아니기에 그 구체적인 골자와 형태가 분명해질수록 이에 대한 사회적 논쟁이 불거질 수 밖에 없다. 따라서 본 논문은 북방한계선을 둘러싼 여러 방안을 논의하기 위한 전제이자 기초로서 서해 북방한계선의 정당성을 다시금 검토한다. 서해 북방한계선의 정당성에 대한 기존의 논의는 대체로 법적인 정당성에 초점을 집중하면서 다른 측면에 대해서는 상대적으로 소홀하였다. 합법성 논의도 북방한계선이 해상에서의 군사분계선임을 간과한 주장이 적지 않았다. 따라서 본 글은 북방한계선의 역사적 기원과 지금까지의 이행과정을 살펴보아 우선 법률 이외의 측면에서 그 정당성을 고찰한다. 또한 법적인 정당성도 검토하되 기존의 법률 논의를 북방한계선이 군사분계선임을 고려했는지에 따라 설득력이 강한 논의와 약한 논의로 구분하고 평가한다. 검토 결과, 서해 북방한계선은 그 역사적 기원과 이행과정이 시사하는 일종의 도덕적 정당성과 역사적 정당성을 지니고 있다. 동선은 정전협정의 실질적인 이행을 가능하게 하였고 서해상에서 유일하게 군사분계선으로 기능해왔다. 법률적으로도 북방한계선은 설득력 강한 합법성 긍정 논의에 의해 충분히 정당성이 뒷받침된다. 따라서 본 글은 서해 북방한계선이 도덕적, 역사적, 법적 정당성을 가지는 해상 군사분계선임을 주장한다. 정부는 이 점을 유의하여 북방한계선에 대한 북한의 부당한 주장에 휘말리지 않아야 한다.

영문 초록

South and North Korea agreed in the Panmunjom Declaration of April 27, 2018 and the military agreement of September 19, 2018 to turn the waters around the Northern Limit Line (NLL) in the West Sea into a “peace zone.” 　 The agreement was not based on a national consensus; political arguments and controversies emerged as details of the agreement became clear. This paper reviews the legitimacy of the NLL to understand the dispute. Most arguments focused on the legal justification of the line itself while the legitimacy of other aspects of the dispute has not been fully examined. In addition, some discussions of legality missed the fact that the NLL is a maritime demarcation line. This paper demonstrates the legitimacy of the line by examining its origin and history. This research reviews not only legality discussions but also evaluates their cogency given the fact that the line is a military demarcation line. This paper argues that the Northern Limit Line in the West Sea can be justified in both a moral and historical context. The line made it possible to maintain the Korean Armistice Agreement and functioned as the only military demarcation line. Consequently, the Northern Limit Line in the West Sea is morally justifiable, historically legitimate, and a lawful military demarcation line on the sea. The South Korean government must keep in mind the legitimacy of the NLL to deal with the North Korean regime.
