부추겨지는 성폭력 역고소와 가해자 연대

국문 초록

이 글에서는 성폭력 가해자들이 피해자와 연대자, 지지자들을 위협하고 협박하는 수단으로 삼고 있는 무고, 명예훼손, 민사상 손해배상 청구 등의 ‘보복성 역고소’와 특히 법인과 함께 기획적으로 진행되고 있는 ‘보복성 기획고소’에 주목하였다. 이 과정을 보기 위해 성폭력 가해자의 저항이 ‘시장화’되어 가고 있는 현황, 그것들을 부추기고 지지하는 가해자 연대와 패턴에 대해 살펴보았다. 최근 ‘성범죄 전담변호사’ 등을 키워드로 가해자 변호에 대한 홍보가 확장되고 있으며, 일부 변호사들은 하나의 사건을 몇 개로 쪼개어 ‘패키지화’하면서 ‘영업수단’으로 삼고 있다. 성폭력 가해자 변호는 점차 불법과 합법 사이의 경계에서 ‘새로운 돈벌이 수단’이 되어가고 있는 것이다. 가해자들은 자신의 성폭력 사건이 폭로된 SNS, 온라인 등에 피해자를 동조하거나 지지하는 자들을 찾아 무차별적인 고소를 남용하고 있으며, 가해자 연대를 형성하여 각종 역고소의 형태와 방식에 대한 정보를 주고받기도 한다. ‘보복성 역고소’, ‘보복성 기획고소’에 대항하기 위해서는 변호사협회 차원에서의 자율적 규제, 수사·재판 과정에서 역고소에 대한 ‘적극적 조치’, 관련 법 제·개정 등이 요구된다. 그러나 피해자들의 경험에서 알 수 있는 가장 적극적인 대항은 피해자에게 이미 내재되어 있는 힘과 피해자 연대, ‘피해자 리더십’으로부터 비롯된다. 또한 성폭력을 문제제기하는 과정에 있어서 형사사법처리가 가지고 있는 가능성을 극대화하되, 남성중심적인 법의 언어에 종속되지 않도록 그것의 한계를 직시하면서 대안적인 운동 전략과 담론이 고민되어야 할 것이다.

영문 초록

This study pays attention to retaliatory counter-accusations , such as false accusation suits, defamation suits, and civil damages claims. In particular, organized retaliatory accusations that are planned out and facilitated by law firms. Perpetrators of sexual violence are using these methods to intimidate and threaten victims, advocates, and their supporters. In recent years, more and more lawyers are publicizing their criminal defense services for perpetrators of sexual violence under keywords such as sex crime specialist lawyer. Some lawyers make package deals out of a case by splitting it into several cases as a business method. Defending perpetrators of sexual violence is becoming a new money-making method on the boundary between illegality and legality. Perpetrators of sexual violence are tracking down sympathizers and supporters of their victims on social media or online platforms where the sexual violence case was revealed. They are then engaging in abusive lawsuits by indiscriminately filing accusations against sympathizers and supporters. Perpetrators also form perpetrator solidarity groups and share information on various forms and methods of counter-accusations. The fight against retaliatory counter-accusations and organized retaliatory accusations calls for measures such as self-regulation by the Bar Association, aggressive action against counter-accusations in the courses of investigation and trial, and law reform. However, the experiences of the victims’ demonstrate that the most active resistance comes from the power already embedded within the victim, from solidarity with the victim, and from victim leadership. Moreover, while we must maximize the potential of the criminal justice system in addressing sexual violence, we must also face squarely the limits of the male-centered language of the law, so as to not be subordinated by it, and consider alternative movement tactics and discourses.
