영문 초록

Trade measures related to the environmental protection have been the central issue of the Committee on Trade and Environment (CTE) of the WTO. It is expected that such trade measures may exhibit an increasing trend if one takes into account the on-going polarized interpretations towards the international agreements on environment such as the green house effect. It may be required for the Korean government and industry to make an industrial adjustment policy by taking into account intrinsic attribute of environment which comprises externalities, public goods and global commons. The focus of environment issues has been shifted from the effective disposal of industrial dumps to the promotion of environment industry during the 1980s and shifted further towards the intellectual property right in the form of patent registration during the 1990s. Such a movement is expected to be expedited with a stringent criterion in the forth-coming New Round which is scheduled to be held in Seattle this coming November. It is recommended for Korea to shape a strategic alliance with those European environment firms, which pioneer the frontiers of environment technology and anti-pollution industry, as a me문 of sterilizing the negative effects from the tightened regulation on “trade and environment” issues. For instance, the application of the PPMs(Process and Production Methods) by the industrialized countries to the developing countries may allow the former to dictate the comparative advantage of the latter by resorting to the intellectual property right. Put it another way, the implementation of PPMs may virtually inhibits the production activities of developing countries based on the evolving comparative advantage. It may be imperative for Korea to formulate a more flexible industrial adjustment policy by fully reflecting the pace of implementation such as “harmonization of competition policy” and “intellectual property right on industrial innovation” for the following two reasons. The first reason arises from the fact the fact that global commons cannot be tackled down without the cooperation among countries concerned. The second one stems from the cool reality that the cost of abiding by the renewed environment regulation will be borne more heavily to developing countries as compared with industrialized countries due to the huge gap in environment-related technological capabilities.
