국문 초록

제주특별자치도 자치경찰은 2007년 2월 28일 발대식을 갖고 정식으로 출범하였다. 자치경찰제도는 제주특별자치도 설치와 국제자유도시를 실현함에 있어서 가장 상징적 의미를 지니고 있으며, 우리나라 최초의 자치경찰기구이다. 제주특별자치도 자치경찰은 출범 이후 그 동안 시행 과정에서 제기되었던 다양한 문제점들을 개선하고자 하였다. 이에 5단계 제도개선을 통하여 권한과 사무 등 많은 부분에서 권한을 이양 받아 자치경찰의 지위 향상, 특별사법경찰 업무의 확대, 교통단속, 통고처분 권한 부여 등 많은 부문에서 제도개선이 이루어 졌으며, 자치경찰의 역량이 강화된 것은 사실이다. 그러나 출범 이후 위와 같은 제도개선에도 불구하고 국가경찰 과의 관계, 사회변화에 따른 치안수요의 확대, 주민의사의 반영, 인구증가에 따른 인력 수급과 그에 따른 재정 문제에 관하여 해결해야 할 개선과제로 남아 있다. 특히 자치경찰의 직무수행과 밀접한 관련이 있는 수사권 부여, 현장의 대응성, 긴급초동조치 등에 있어서 문제점이 제기되고 있다. 이와 같이 제기되고 있는 문제점들은 자치경찰의 기능강화를 위해 향후 제도개선을 통하여 해결해야 할 과제 들이다. 이러한 맥락에서 본고에서는 제주특별자치도 자치경찰의 확고한 정착과 기능강화를 위하여 나아가서는 전국적으로 확대 실시되어야 하는 자치경찰의 전형적인 모델이 되기 위해서 자치경찰의 운영 실태와 법적 현황을 검토하고 제도개선 과제를 제시하고자 한다.

영문 초록

Jeju Special Self-governing Police officially launched on February 28, 2007. The autonomous police system has the most symbolic meaning in establishing Jeju Island and implementing the international free city, and it is Korea s first autonomous police body. Jeju Special Self-governing Police attempted to remedy various problems that had been raised in the implementation process since its launch. Thus, through the five-step system improvement, the authority of the police was transferred from the authorities and the office to the position of the local police, the expansion of special law police work, traffic control, and the authorization of the suspension. However, despite such system improvement since its inauguration, it remains a matter of improvement to be addressed in relation to the national police, increasing security demands due to social changes, reflecting residents` intentions, manpower supply and financial problems resulting from the population increase. In particular, problems have been raised in granting investigative rights that are closely related to the duty of local police, responding to the site and taking emergency initial actions. Such problems are tasks to be solved through future system improvement in order to strengthen the function of local police. In this context, the main school aims to identify the operation of the local police and present a task for improving the system in order to become a model of the local police, which should be established and expanded nationwide.
