국문 초록

소방공무원의 현행법상 지위를 향상하기 위하여 『현행법상 소방공무원의 법적 지위와 수사』(‘The legal status and Investigations of Firefighter in current law’)에 대하여 연구하였다. 이 영역은 소방관의 인권보장이 모든 국민의 인간다운 삶의 보장과 직결되기 때문이다,소방관이 소방활동의 목표를 달성하기 위하여 최선을 다함에도 불구하고 직무상 피할 수 없는 위법행위로 손해가 발생한 것에 대해서는 소방활동의 특수성을 인정하여 정당행위로 인정해야 함에도 이를 부정한다. 또한 재해ㆍ재난사건에 대한 ‘독립수사권’도 없다. 반면에 소방관에게는 과중한 의무와 자기희생(self-sacrifice)만 강요한다. 소방관들은 심지어 자신을 표현하기를 ‘국민의 머슴’이라고 말한다. 이와 같은 부당한 대우를 받고 있다고 느끼고 있는 소방관들의 생각을 우리는 해소시켜야 한다. 「소방기본법」 제1조(목적)를 실천할 수 있도록 정당행위의인정범위확대, 독립수사권보장, 국가직공무원 전환 등으로 ‘권력분립평등의 원칙’을 실현하여 국민의 생명과 재산, 자연환경을 보호할 수 있는 법과 제도의 개선이 필요하다.

영문 초록

The objective of this article about ‘The legal status and Investigations of Firefighter in current law’ is to improve the status of Firefighter officer. Because the Firefighter’s human rights are related to ensure the public safety directly. Although the Firefighter dedicates his best efforts to accomplish his role to extinguish the fire and save the life, occasionally, he can be suffered a great loss during his inevitable, official activity. Nevertheless, his loss have been ignored completely. His actions should be legally accepted, as an inevitable the act of rescue. Moreover, he dosen’t have the right of independent investigation about an accident or disaster where he take. Only he should be forced to perform his duty and self-sacrifice. Even he calls himself the public’s servant(massum:머슴) and this sense of shame, unjustly treated, must be resolved. It’s time to make extending the range of acknowledgement about justified act and guarantee of Firefighter’s own the right of investigation. Also, It is urgent to fix the firefighter status as the Government employee. In addition, it should be extended the justification and permissible range of the firefighter’s act in the rescue. In order to achieve the aim of 「FRAMEWORK ACT ON FIRE-FIGHTING SERVICES Article 1 (Purpose)」 by “the separation of power and isocracy maxim”, above things are should be considered. To complement the judical system is needed for protection the life and property of the public and natural environment.
