지방공무원 징계현황 및 소청심사의 운영실태와 개선방안

국문 초록

본 연구는 광역자치단체를 중심으로 한 지방공무원의 징계현황과 소청심사제도 운영현황을 분석하여 소청심사제도의 개선사항을 제안한 것이다. 2013-2016년간 17개 시ㆍ도 소속 1,676명의 공무원이 징계처분을 받았다. 4년간 징계처분 받은 지방공무원의 소청심사결과 평균 41.9 %가 인용 되었다. 이러한 징계처분현황 및 소청심사 결과자료를 토대로 문제점과 시사점을 도출하여 다음과 같은 개선사항을 제안하고자 한다. 첫째, 지방소청심사위원회는 독립적인 기관으 로 운영되어야 한다. 둘째, 지방소청심사위원회의 위원은 전문성과 책임감을 강화해야 한다. 셋째, 소청심사제도에 관한 독립된 법률을 제정할 필요가 있다. 넷째, 소청심사위원회의 외부 위원 들은 공개채용 하여야 한다. 다섯째, 지방소청심사위원회의 위원 및 소청심사결과는 공개되어야 한다.

영문 초록

This study suggests the improvement by analyzing the Status of disciplinary action of the local public officials and the operation status of the appeal examination system centering on the regional autonomous organizations in Korea. During the four years, 1,676 of the lo cal government officials of the municipalities were disciplined. An average of 41.9% was cited for appeal by the local public officials who were disciplined for four years. Based on these disciplinary measures and the appeal review data, we suggest the following improvements by drawing problems and implications. First, the local appeal commission should operate as an independent agency. Second, the judges of the appeal commission need to improve their professionalism and take a responsible attitude. Third, it is necessary to enact laws for the appeals system. Fourth, external members of the appeal commission should be openly recruited. Fifth, the list of judges of local appeals and the results of appeals should be opened.
