지능정보사회에서 국가감사기능의 재정립에 관한 시론적 고찰

국문 초록

지능정보기술의 발전으로 행정환경과 국가기능의 변화가 예상된다. 행정처리에 인공지능을 활용한 지능형 전자정부 구현 , 정책계획과 집행에 민간의 참여 확대, 초연결 네트워크 행정으 로 실시간 행정서비스 및 국민의 의사표시 , 데이터를 기반으로 한 플랫폼형 정부 등이 전망된 다 . 정보사회에 대응하여 감사원은 효율성 감사 , 정책감사 , 성과감사 , 시스템감사 , IT 감사 등 실정에 맞게 다양한 노력을 하여 왔다 . 그런데 감사기능의 정립과 감사제도의 개선을 마무리 하기도 전에 지능정보기술의 발전과 제 4차 산업혁명의 진행으로 급격한 감사환경의 변화가 있을 것으로 전망되고 있어 감사기능과 감사제도에 대한 추가적인 고민을 안게 되었다 . 감사기 능의 정립은 행정환경의 변화와 국가기능의 변화에 연동하여 고민하여야 한다 . 특히 인간중심 의 지능정보사회를 만들기 위해서 국가기능을 새로운 유형의 기본권 보장과 안전망 강화, 위험예방 등 헌법친화적으로 재구성해야 하므로 국가기능의 일부인 감사기능도 헌법적 역할을 수행할 수 있는 방향으로 정립하여야 할 것이다 . 인간친화형 지능정보사회 견인, 기본적 인권 보장에 기여, 정보권력의 분립 , 지능정보사회에 대비한 신뢰기반 구축 등을 중요한 감사기능으로 검토할 수 있다 . 감사관련 헌법상 쟁점으로는 감사의 범위와 감사절차상의 권한, AI 감사와 AI 활용감사의 헌법적 수용가능성을 들 수 있다. 그리고 감사제도 개선방안으로 헌법상 감사 범위에 사전예방감사와 정책감사 포함, 자료취득권 또는 정보접근권 법제정비 , 감사원법에 감사의 정의규정 신설과 개인정보 취득 명시 등을 제안한다 . 그리고 AI 감사 /AI 활용감사를 위해서는 별도 법률을 신설하거나 감사원법을 대폭 개정하는 것이 필요해 보인다. 4 차 산업혁명에 대비하는 종합적인 정책을 객관적이고 공정하게 감사하기 위해서는 최고감사기구의 소속형태 에 관계없이 감사기능의 독립성을 확보하는 방향으로 제도보완을 할 필요도 있음을 지적한다.

영문 초록

The development of Intelligent Information Technology is expected to change the administrative environment and functions of the nation. The examples are Real-time administrative services, and platform-based government, the intelligent e-government utilizing Artificial Intelligence, expansion of private participation in policy planning and enforcement. And it is expected that the national functions will conduct building human-centered society, strengthening private-public partnership, maintaining safety from risks, guaranteeing core fundamental rights. The direction of the audit functions should be constitution friendly. Traction for Human-friendly intelligent information society, contributing to basic human rights guarantee, information power separation, and preventing dysfunction of informitization can be important audit functions. In order to improve the audit system, it can be proposed that the reorganization of the audit scope, the direct prescribing of data acquisition right or the information access right in Constitution, and the establishment of audit definition in the Board of Audit and Inspection Act. For AI audit and AI based audit, it is required to enact an independent law or drastically revise the Law on Audit and Inspection. In order to objectively audit the comprehensive policy to prepare for the fourth industrial revolution, it is necessary to complement the audit system in order to secure the independence of the audit function.
