고위공직자비리수사처 설치 방안 검토

국문 초록

세월의 변화를 느낀다. 문재인 대통령 당선 이후 스스로 개혁할 능력이 없었던 검찰은 적폐(積幣) 세력의 으뜸이 되어 외부의 힘에 의해 오래 쌓인 폐단을 걷어내야 할 처지에 놓였다. 적폐를 해소하기 위해 논의 중인 가장 현실적인 방안은 고위공직자비리수사처의 신설과 검찰의 수사권을 분할 또는 이양하는 수사권 조정이다. 지금 정치권의 분위기에서는 공수처의 신설이 검찰 개혁의 첫 출발점이 될 듯하다. 공수처의 설치는 문재인의 정치 분야 대통령 선거 공약사항들 중 권력기관 개혁의 한 축으로 그동안 적폐로 남아있던 검찰 등 고위공직자의 부정부패와 권한 남용을 방지함으로써 보다 정의로운 나라를 만들기 위한 하나의 노력이라고 볼 수 있다. 지금까지 10여 년 동안 공수처 설치 논의가 국회에서 있어 왔고, 현재 국회에 계류 중인 공수처 설치 법률안은 모두 3건이다. 노회찬, 박범계, 양승조 의원이 각각 대표발의 하였다. 따라서 이 연구에서는 세 가지 법률안을 중심으로 각각의 공통점과 차이점을 비교하면서 공수처 설치 및 운영 방안에 대해 검토하였다.

영문 초록

Time changes. Korean Prosecution Service, which has been incapable of reforming itself should be reformed by new President Moon Jae-In. He will do his power to skim off some of the negative effects of a long time. Now Korean Prosecution Service have no will to change. So The change is made by outside forces, one of them is Korean Corrupt Practices Investigation Agency. The installation of Korean Corrupt Practices Investigation Agency is a chief public politics of the president power apparatus of reform, which remains a practice that has as one of the election campaign promises. By preventing corruption and abuse of authority can be seen as one of the efforts to build more just country. So far, more than 10 years, the installation of Korean Corrupt Practices Investigation Agency is at the National Assembly debate, and the bills, chief public installation is currently pending at the National Assembly, all three cases. Rep. Roh Hoe-chan, progressive, Pak Beom-Gye, Yang Seung_Jo required by national teams. Therefore, the study, each compared the similarities and differences between reform of the legislation focusing on three things that are propelled by the initiation and about the management plans.
