국문 초록

국제물품매매거래는 물품의 이동이 국가 간에 이루어지는 거래로서 다른 나라의 매매당사자와 계약을 통해서 물품의 권리이전을 목적으로 하는 거래이다. 그러나 계약당사자 일방의 계약위반으로 분쟁이 발생한 경우에 준거법 선택에 대한 문제가가 발생하게 되며, 이를 해결하기 위해 국제물품매매계약의 통일법으로 제정되어 효력을 발휘하고 있는 CISG라는 통일규정이 있다. 본질적 계약위반에서 본질성에 대한 판단기준을 검토하는 것은 계약당사자에게 추가적인 기회를 부여하거나 계약해제를 통한 계약종료 등 구제수단에 대한 신속한 결정을 정할 수 있게 한다. 따라서 본질적 계약위반과 관련된 본질성에 대한 판단기준을 종합적으로 검토할 필요가 있으며 이를 통해 계약당사자들이 계약위반과 관련하여 판단할 수 있는 근거를 제공하고자 한다.

영문 초록

Purpose : The purpose of this study is to confirm the judicial of standard and to review the recent case and domestic case under the CISG Article 35 (2) (a), (b), (c) and (d). Research design, data, methodology : This paper review introduction background of CISG, comparison and analysis among CISG cases. It is necessary to concentrate upon the introduction background of CISG, and analysis fundamental breach of contract. Results : Most of the disputes arise out of disputes when the specification is not explicitly specified, so it is necessary to judge the criterion of fundamental breach of contract in order to enhance the legal stability of the CISG and the predictability of the parties. In addition, since the documents are frequently used as means for linking with the goods. Conclusions : This paper concludes that the interpretation of fundamental breach of contract under CISG Article 35 (2) such as (a) indicates the possibility of resale in the buyer s country, (b) an expression of the buyer s intentions to use for particular purpose, (c) consistency of secondary quality, and (d) product standard of packing to protect.
