국문 초록

UCP600이 적용되고 있지만 통지업무와 관련하여 제2 통지은행이 새롭게 규정되어 적용됨으로써 현지 실무에서는 제2 통지은행과 관련한 통지관습이 아직까지 명확하게 정립되어 있지 않고 있다. UCP600에서는 통지은행이 수익자에게 신용장과 어떤 조건 변경을 통지하기 위해 타은행(제2의 통지은행)의 서비스를 이용할 수 있도록 하고 있는데 신용장이나 조건 변경을 통지함으로써 제2의 통지은행은 자신이 수취한 통지의 외관상의 진정성에 관해 자신을 충족시키고 있다는 것 그리고 그 통지가 수취된 신용장의 제조건과 조건변경을 반영하고 있다는 것을 확인할 의무를 부가하고 있다. 그리고 신용장을 통지하기 위해 통지은행 또는 제2의 통지은행의 서비스를 이용하는 은행은 신용장에 대한 조건 변경을 통지하기 위해 동일한 은행을 이용하여야 한다고 규정하고 있다. 통지은행은 개설은행의 요청이나 수권에 의해 지정되지만 제2 통지은행은 통지은행이 선택할 수 있도록 하고 있다는 것 그리고 제2 통지은행을 통해 신용장을 통지하였으면 조건변경도 동일한 은행을 통하여 통지하도록 하고 있는 것은 실무에서 혼선을 야기하고 있다. 따라서 본 논문은 UCP600에서 신용장통지 관련규정과 통지실무를 살펴봄으로써 그 문제점과 해결방안을 모색함으로써 신용장거래의 원활화에 기여하는 것을 목적으로 한다.

영문 초록

Purpose : The purpose of this paper is to contribute to streamlining documentary credit transactions by finding the problems and solutions of advice practice of documentary credit by way of studying the regulations of advising of credit and amendments and its practice under UCP600. Research design, data, methodology : This paper is composed of five chapters. Chapter Ⅰ deals with the introduction of this paper and Chapter Ⅱ explains the previous studies. Chapter Ⅲ deals with the regulations of advising of credit and amendments and its practice under UCP600 and Chapter Ⅳ deals with the problems and solutions of the regulations of advising of credit and amendments. Chapter V concludes this paper. Results : This paper finds the problems and solutions of the regulations of advising of credit and amendments in view of the choice, legal position, unavailability, burden and cost of second advising bank. Conclusions : This paper concludes that using second advising bank depends on the agreements between applicant and beneficiary, issuing bank and advising bank.
