영문 초록

Open source software is s software distributed with its original source code, anyone can modify it, and redistribute it without the permission of original author. The research of big biotechnology projects with public funds, like Human Genome Project or International Hapmap project, needs to be shared publicly without any limitation. To make sure this purpose, they adopted the open source model. This share of research result, however, make it possible for some people or some commercial entity to acquire so-called “parasitic patent”. Because the software is protected by copyright law and most of biotechnology researches are protected by patent law, some mismatches are unavoidable. But, open source model is still useful to some points, people want to adopt it. To avoid the parasitic patent, new approaches of open source model(The Equitable Access License, CAMBIA License, etc.) were made, and are being tested about their effectiveness. We should bear in mind that intellectual property law is not only for authors or inventors, but also for society and community.
