국문 초록

재판절차의 적정성 내지는 그 결론에 대한 당사자의 신뢰를 확보하기 위해서는 법 적용의 대상이 되는 구체적 사실이 유효하고 적절한 절차를 통하여 객관적으로 확정되어야 한다. 그러나 오늘날 행정소송, 공해·환경소송이나 의료과오소송, 제조물책임소송, 회사관계소송 등에 있어서는 국가나 지방자치단체, 의료기관, 기업체 등에 증거가 집중되어 있고, 그 상대방인 일반국민이나 소비자, 환자 등은 자기가 증명하여야 할 사실에 대한 증거 입수가 매우 어려운 경우가 일반적이다. 이와 같은 증거의 구조적 편재 현상을 그대로 방치하게 되면, 일반국민이나 환자, 소비자 등은 상대방이 그들의 유·불리에 불구하고 적극적으로 중요한 증거를 제출하여 주지 않는 한 증명을 제대로 할 수 없어 진위불명의 상태에 이르게 되고 증명책임분배원칙에 따라 패소할 수밖에 없게 된다. 이러한 사태는 소송당사자 사이의 실질적 평등을 해치는 것이므로 공평한 소송절차의 실현을 위해 이와 같은 불평등을 시정할 필요가 있다. 이를 위해서는 증거의 구조적 편재 현상에 효과적으로 대응할 수 있을 뿐만 아니라, 효율적인 증거개시·수집을 위한 적절한 제도를 설립하여 운영하는 것이 매우 중요하다 할 것이다. 본 연구보고서는 증거의 구조적 편재 현상을 극복하고, 효율적인 증거개시·수집을 위하여 현재의 제도를 어떻게 개선해야 하는지에 대해 다루고 있다. 논의의 중심은 크게 세 가지로서 우선, 증거의 개시 및 수집을 위한 현행 민사소송법상의 제도를 문서제출명령과 증거보전을 중심으로 살펴보았다. 다음으로 효율적인 증거 개시·수집을 위한 각국의 제도에 대해 미국의 증거개시제도와 독일의 독립적 증거절차, 일본의 당사자조회제도를 중심으로 제도의 내용과 운용실태 등에 대해 살펴보았다. 마지막으로 효율적인 증거개시·수집을 위하여 현재의 우리 제도에 어떠한 개선 방안이 있을 수 있는지에 대해 현행 법령의 개정을 포함하여 다양한 방향으로 이를 고찰하였다.

영문 초록

To achieve justness of judicial proceedings and credibility of trial results, certain facts as an object of legal application must be determined through a valid and appropriate procedure. However, recent aspects of legal actions these days show that evidence is concentrated on the part of the State, local governments, medical institutions, or corporations, especially in an administrative litigation, pollution/environmental lawsuit, medical malpractice suit, product liability action, and corporate litigation. In these legal actions, therefore, an adverse party who is usually a citizen, consumer, or patient has difficulty obtaining the evidence of facts to prove. If such phenomenon of ‘maldistribution of evidence’ is neglected, a party of citizen, consumer, or patient is not able to prove the facts sufficiently, unless their adverse party actively submits important evidence, which is unlikely to happen for the party is not expected to provide its unfavorable evidence. This situation leads to a non liquet and the party who has not proved satisfactorily is likely to lose the case according to the burden of proof. For this situation considerably damages substantive equality among the parties in a lawsuit, such inequality should be rectified in order to realize just and fair judicial proceedings. Thus, establishing and operating an appropriate system is essential to cope with the phenomenon of ‘maldistribution of evidence’ and to develop effective discovery practice. This research report suggests ways to overcome the maldistribution of evidence and to improve our current system of discovery in a more effective way. The research is based on three parts. First, the research examines current discovery under the Civil Procedure Act, focusing on orders for the production of documents and the preservation of evidence. Furthermore, the research conducts a comparative analysis of the systems for effective discovery in several countries, including discovery procedures in the United States, the independent evidentiary proceedings in Germany, and the inquiry to opponent in Japan. Finally, the research devises various ways to improve our existing discovery in Korea, focusing on the revision of current provision.
