의무교육제도에 관한 헌법사상사적 고찰

국문 초록

오늘날 의무교육과 관련하여, ‘종교’, ‘부모의 교육관’, ‘자녀의 특성’ 등을 이유로 의무교육기관 이외의 장소에서 자녀를 교육하고자 하는 시도가 적지 않게 행해지고 있다. 그런데 문제는 우리 교육관계법상 취학강제규정이 있어서 의무교육을 받지 않을 경우 법률위반으로 처벌될 수밖에 없다는 것이다. 그런데 이런 법률상 취학강제규정은 헌법상 보장되는 아동의 학습권, 부모의 교육권 침해문제와 헌법 제31조 제2항의 ‘교육을 받게 할 의무’ 규정에 관한 위헌가능성 문제를 제기한다. 왜냐하면 우리 헌법은 제31조에서 교육을 받을 권리(제1항)를 보장하고 있고, 의무교육제도(제2항, 제3항)는 교육을 받을 권리를 실질화하기 위한 규정으로 해석되기 때문이다. 따라서 본 논문에서는 그 분석방법으로, 헌법사상사적 기준에 입각하여 우리의 의무교육제도가 종래 ‘절대주의적 의무교육제도’, ‘복지주의에 입각한 의무교육제도’, ‘인권사상에 근거한 의무교육제도’라는 3가지 타입 중 어디에 해당하는지를 고찰하고, 헌법 제31조 제2항에 규정된 ‘교육을 받게 할 의무’가 과연 취학강제를 의미하는지 여부에 관하여 검토하였다.

영문 초록

These days, Several attempts that parents desire to educate their children at places except compulsory educational institution have been done by reason of ‘religion’, ‘parents’ view of education’, ‘children’s special character’ ect. in relation to compulsory schooling. It’s the problem that not to receive compulsory education cannot but infringe the compulsory school attendance provision on the law of education. by the way, the compulsory school attendance provision on the law of education raises a question to violate children’s right to learn and parents’ right to education on constitution. Also, it is necessary to consider whether the compulsory school attendance provision on the law of education violate the provision §31② on the constitution in Korea. Therefore, this study considers that the compulsory schooling system of Korea is related to what type among ‘the absolutistic compulsory schooling system’, ‘the compulsory schooling system based on welfarism’, ‘the compulsory schooling system based on human rights’, and what the meaning of ‘the compulsory school attendance’ of §31② on the constitution is indeed.
