프로젝트화물보험약관에 대한 일고찰

국문 초록

최근 유가의 급락으로 인하여 세계경기 뿐만 아니라 해양플랜트산업도 많은 어려움을 겪고 있다. 특히 대형 프로젝트의 최종투자결정 지연, 금융 공급 중단, 해양플랜트의 용선취소는 국내 조선소, 중공업, 건설사 등에 막대한 경제적손실을 초래하고 있다. 대형 프로젝트의 안정적인 운영을 위해서는 복잡하고, 다양한 프로젝트 생산설비들의 적기 공급 및 생산이 필수적이며, 이와 관련된 위험관리체계의 구축은 매우 중요하다. 이러한 측면에서 피보험자는 보험목적물의 인도지연에 따른 다양한 간접손해를 담보하여 안정적인 공급관리체계를 유지하기 위하여 프로젝트화물보험이 필요하다. 특히 프로젝트화물보험은 제약조건이론에 따라 보험목적물의 종류에 따른 담보위험 및 면책위험을 구분하여 피보험자에게 합리적인 보험료로 다양한 위험을 담보할 수 있는 유용한 보험이다. 그럼에도 불구하고 여전히 실무자들은 프로젝트화물보험약관의 내용이 난 해하고 복잡하여 보험사고 발생시 적절한 대처를 못하고 있다. 그리고 피보험자는 전문지식과 경험이 부족하여 비싼 보험료를 납입함에도 불구하고, 일방적으로 보험자에 의해서 모든 위험을 담보하는 보험약관을 수용하고 있는 실정이 다. 따라서 이 논문은 프로젝트화물의 개념과 특징, 주요 약관에 대해서 해석론적으로 검토하였고, 이를 바탕으로 관련된 주요 법적 쟁점사항에 대한 법적 검토 및 개선방안을 제시하였다.

영문 초록

Not only the world economy but also offshore plant industry is suffering from the recent plunge in oil price. Particularly, delay in final investment decision of big projects, suspension of financial supply, and ship chartering cancellation of offshore plants are causing enormous economic losses to domestic shipyards, heavy industry and construction companies. For stable management of big projects, well-timed supply & production of production facilities for big projects is essential, and its related risk management system construction is very important. In this respect, the insured is in need of project cargo insurance in order to maintain the stable supply management system by ensuring various consequential damages resulting from delay in delivery of insurance objects. Notably, project cargo insurance is a useful one which can ensure the insured various risks with reasonable insurance premium by assorting a guarantee and immunity risk consequent on the sorts of insurance object according to the theory of constraint. Nevertheless, field managers still fail to take a proper measure in time of insurance accidents because the contents of project cargo insurance clauses are difficult and complicated. In addition, the realities are that the insured are accepting insurance clauses ensuring all-risks unilaterally by the insurer because the insured do not have expertise and experience. Accordingly,this study examined the concept and characteristics of project cargo, and major insurance clauses on analytic theory, on the basis of which this paper did legal examination of the involved major legal controversial issues and suggested improvements thereof.
