보험증권상 피보험자의 사기행위와 보험계약의 효력

국문 초록

보증보험계약에서 보험자의 보험금지급책임이 발생하기 위해서는 주계약상의 채무불이행이라는 보험사고가 있어야 하는데, 채무불이행은 채무를 이행하지 못하는 데에 채무자의 귀책사유를 그 요건으로 하므로 인위적인 사고라는 특징을 가지고 있다. 이로 인해 보험사기에 이용될 위험성이 잠재되어 있는 것이다. 할부금융특별약관이 적용되는 보증보험상품에서 보험증권상 피보험자인 판매회사의 기망행위가 개입되어 보증보험계약을 악용한 사례가 다수 발생하였는데, 최근에 선고된 대법원 판결은 구매자와 판매회사가 자동차 매매계약을 체결하고 그 매매대금의 지급을 위하여 할부금융대출을 받은 경우에 그러한 할부금융대출약정이 보증보험계약의 보증대상인 주계약이 되고, 할부금융사가 피보험자로 된다고 판시하였다. 따라서 보험증권상 피보험자인 판매회사의 기망행위가 있었다 하더라도 보증보험계약이 무효가 되는 것은 아니다.

영문 초록

For the purpose of the guarantee insurance, the insurer’s liability of indemnity is acknowledged in an insurance accident caused by policyholder’s bad faith or gross negligence on a main contract. But the non-fulfillment of contractual obligation by the policy-holer has a characteristic that requires an insurance accident occur intentionally due to the negligence of the obligator. That is why there is a potential risk of this feature to be misused in insurance fraud. In fact, there have been several cases where guarantee insurance products attached by installment finance special clause were misused in a deceitful act by a sales company, who was the insured under the guarantee insurance policy. The Supreme Court recently ruled that in the case where a buyer and a seller concluded a sales contract and the buyer received installment finance loan to pay the seller, such installment finance loan agreement should be considered as a main contract covered by the guarantee insurance, and the installment fiance company as the actual insured. Therefore, the guarantee insurance contract shall be still valid even if there was a deceitful act by the sales company who was the insured upon the insurance policy.
