소년법에서의 화해권고제도의 개선방안

국문 초록

화해권고제도란 소년보호재판에서 소년법 제25조의 3이 정한 취지에 따라 보호소년에 대한 품행의 교정과 피해자의 보호를 위해 법원이 위촉한 화해권고위원이 당사자들에 대해 화해를 권고하는 절차를 말한다. 이러한 화해권고제도는 화해전문화와 화해의 인간화를 내용으로 구성되며 교정복지와 회복적 사법 및 사법복지를 이념으로 한다. 이제도에 대한 이해는 심리학 등 다양한 학제적 접근이 필요하나 선행연구들과 현행제도는 학제적 접근이 부족하다. 따라서 기존연구들과 현행제도가 간과한 측면들을 중심으로 본 제도의 이념과 개선방안들을 제시하고자 한다. 또한 화해권고위원론에 대한 독창적인 주장을 내세워 화해권고절차에서 화해 권고위원의 중요성을 강조하였다.

영문 초록

Korea's reconciliation recommondation system under the juvenile act is the procedure which is built bridges between them by reconciliatiom recommondatiom committee member who are commissioned by the juvenile court authorities for correction the juvenile offender and protecting the victim related to the product of protection public service. These reconciliation recommondation system under the juvenile act which produces correction public service on the victim is composed of the humanization of reconciliation, the specialization of reconciliation and is based on the idealogy of the correction social welfare, restorative justice welfare and forensic social welfare (judicial social welfare). These reconciliation recommondation system under the juvenile act needs interdisciplinary approach inclusive of the psychology approach. But the existing study of it is short of the interdisciplinary approach inclusive of the correction welfare service. Therefore, I would like to assert approach to improve the existing reconciliation recommondation system which existing studies have passed over about it and to show my original view about the reconciliation recommndation member.
