한국, 미국, 일본의 건강장애의 정의 및 만성질환의 유형 비교 고찰

국문 초록

이 연구의 목적은 우리나라의 건강장애 특수교육 대상의 정의를 미국과 일본의 법적 정의와 비교함으로서 미국과 일본의 법적 정의와 만성질환의 범위가 우리나라 건강장애 특수교육 대상 학생의 진단 및 서비스 제공에 함축하는 시사점을 알아보는 데에 있었다. 연구 결과, 우리나라, 미국, 그리고 일본은 구체적인 표현의 차이는 존재하지만, 건강장애에 대한 기본적인 개념은 비슷하였다. 하지만, 우리나라에서는 건강장애 특수교육대상자로 선정되기 위한 주요 질환이 무엇인가에 대해 전혀 제시하지 않고 있다는 점에서 미국과 일본의 정의와 달랐다. 또한, 건강장애에 포함될 수 있는 질환에 관하여, 우리 나라에서는 특수교육법상으로는 전혀 가이드라인을 제시하지 않았던 반면에, 미국에서는 12종의 질환을 구체적으로 제시하고 있을 뿐만 아니라 다른 가능한 질환들에 대해서도 언급하고 있었고, 일본에서도 아토피성 피부염 같은 알레르기 질환, 근육 디스트로피, 비만증, 그리고 우울증 등의 다양한 정신질환 등을 포함하여, 소아암 위주로 건강장애를 진단하는 우리와는 달리 매우 폭넓게 질환들을 다루어 건강장애의 범위가 이루어져 있었다. 따라서, 우리나라에서도 현장의 혼란을 최소화하고 도움이 필요한 건강장애 학생들이 적시에 적절한 도움을 받지 못하여 신체적 건강 이상의 괴로움을 당하지 않도록 하기 위해서, 국가는 건강장애의 정의 및 만성질환의 범위에 대한 가이드라인을 제시할 수 있도록 정책을 연구하고, 그에 따라 적절히 법 규정을 수정하여 제시할 필요성이 있다.

영문 초록

In this study, I compared the legal definition of the USA and Japan to the legal definition of health imparement in Korea to evaluate the implications to the South Korea’s health impairment diagnosis and service delivery in a range of chronic diseases and the legal definition of the USA and Japan. As a results, existing specific differences in the expression, the basic concept was similar to the health disorder of South Korea, USA, and Japan. However, the definition of South Korea were different from them of USA and Japan in that it does not provide for all the major diseases to be named as a health disorder to be special education subjects. In addition, with respect to which can be included in health disorders, in Korea, did not provide guidelines apparently in special education law. on the other hand, in the United States there are specific recommendations of 12 kinds of diseases referred to as diseases, and for the other were. in Japan, addressed the disease consisted of a very wide range of health impairments including allergic diseases such as atopic dermatitis, muscular distrophy, obesity, and a variety of mental disorders such as depression, but, we are focused on childhood cancer to diagnose health impairment otherwise. Therefore, the development of guidelines for the definition of health disorders and the scope of chronic disease is needed in order to minimize the confusion of the field and suffering more than physical health from which students with disabilities not received the proper help in need of timely health in South Korea.
