국문 초록

경찰통제는 경찰목표나 계획을 효과적으로 달성토록 하는 중요한 경찰관리 기능의 하나로서 경찰행정의 신뢰성ㆍ합법성ㆍ정치적 중립성 확보와 함께 경찰조직의 부패방지와 건전성 유지를 위해 그 필요성이 강조되고 있다. 특히 국민의 대표로 구성되는 국회에 의한 경찰통제는 주기적ㆍ제도적인 통제 유형으로서, 경찰의 제반 활동에 관한 사전적이거나 사후적인 동의 내지 승인 및 시정조치를 의미한다. 이러한 국회의 경찰통제는 경찰의 재량권과 신축성을 보장하면서 경찰통제의 적정성 및 효율성 확보를 통해 궁극적으로는 국민에 대한 치안서비스 제공의 극대화를 도모하는데 그 의의를 갖는다. 다만, 국회는 경찰통제를 위한 다양하고 실효적인 수단을 갖고 있는 동시에 대표적인 정치기관으로서 여러 가지 한계를 안고 있다. 본 연구의 목적은 국회의 경찰관련 입법활동과 예산결정 및 국정감사를 중심으로 경찰통제의 실태를 효과성을 중심으로 분석하여 향후 국회의 對 경찰통제력을 제고하는데 있다. 연구범위는 제16대 국회부터 제18대 국회까지 약 10년(2000~2010)동안으로 한정하여 경찰청 소관 법률안의 폐기ㆍ부결ㆍ수정 현황과 경찰청 일반회계 세출예산안의 수정경향 및 경찰청 국정감사의 심층도와 성과도를 분석하였다. 다만, 법률안 제출 및 처리ㆍ가결 현황은 1948년 제헌 국회 이후 2010년 1월 현재까지 약 60여 년 간으로 분석범위를 확대하였다. 이를 위해 국회가 발간한 입법 및 예산심의 및 통계자료를 중심으로 문헌조사를 실시하였고 다음과 같은 연구결과를 도출했다. 첫째, 경찰관련 법률안 제출건수는 해마다 증가 추세에 있으나, 그 처리실적은 매우 저조하였으며, 법률안 제출실적은 의원발의가 정부제출을 크게 앞서지만 실제 법률안 처리율이나 가결율은 정부제출 법률안이 의원발의 법률안을 월등하게 앞서는 것으로 나타났다. 둘째, 국회의원 임기 내에 처리되지 못하고 자동 폐기되는 경찰관련 법률안이 해마다 증가하고 있으며, 법률안 심의를 위한 공청회 활용실적이 저조하고, 의원발의 법률안의 상당수가 극히 한정된 일부 법률의 일부 조문 개정에 집중되고 있다는 점, 그리고 경찰청 소관행정입법에 대한 국회통제 제도가 형식적으로 운용되고 있는 것이 문제점으로 드러났다. 셋째, 국회의 경찰예산에 대한 통제는 정권과 국회 다수당을 누가 차지하느냐와 같은 정치적 요인에 영향을 받고 있는 것으로 나타났다. 경찰예산의 성질별 분류에서는 경직성 경비에 대한 국회의 통제는 미미하였지만, 기능별 분류와 함께 우선순위가 높은 경찰예산에 대해서는 국회가 증액과 삭감을 통해 비교적 자율성 있는 통제를 하고 있는 것으로 나타났다. 넷째, 국정감사와 관련하여 제16대 국회에 비해 제17대 국회는 감사 심층도가 떨어졌지만, 감사 성과도는 크게 향상되었다. 결론적으로 우리나라 국회는 對 경찰통제에 있어 입법활동 보다는 예산결정과정에서 보다 효율적이고 자율적인 통제를 하고 있으며, 국정감사의 경우 성과측면에서 일정부분소기의 목표를 달성하고 있다.

영문 초록

Controlling police is one of the main functions which manage police to achieve police purpose and its plan effectively. It is becoming essential not only for police administration's credit, political neutrality and policing legality but also for the prevention of police corruption and its right way. Specially, controlling police by the National assembly, as a systematic and periodic type, plays important role on setting prior or post agreement and approvals or measuring corrects to the police. Controlling the police of the assembly fundamentally aims for maximizing public security services by allowing police to have its own authority and flexible expansion while by exercising political power on the police by the name of appropriateness and effectiveness of police controlling. Meanwhile, the National Assembly has placed critical situations as representative political organization even it has diverse and useful ways to control the police. On the purpose of raising productivity of controlling police, this research evaluates effectiveness of assembly's controlling police with documental investigation about policing legislative activities, budget reviews and statistical data. The research set 10 year duration(2000~2010) from 16th to 18th assembly limits its investigation range to focus on the correct tendency of the police general account budget and profundity and complete level of parliamentary inspection of police administration. Also the study set the other over 60 year duration from 1948 where the Constituent Assembly founded in order to view legislative bills for police administration and actual processing condition. With documentary records related to legislative bills and budget deliberation issued by the National Assembly, the study draws results below. First, presentation of bills related police tends to be increasing each year, but the proposed bills' processing performance stays low degree. Legislative bills came from lawmaker's proposals are much more than from government's submission. But when it comes to processing performance or approval rate, legislative bills from government has been beyond the lawmaker's. Second, assembly's control system for the administrative laws of the police department seems to be operated by political formality such as the lack of public hearing application on the bills, unbalanced proposals only focusing partial letter amendments, and bills abolition due to expiration of terms in office(4 years). Third, the police budget control is greatly influenced by political factors. It surely seems to be determined by which party would take power and more seats. The National Assembly has great influence on police budget, especially, on flexible expenses like criminal investigation or purchase of police vehicle etc. On the other hand, it is found that the Assembly tends to let the fixed expenses like personnel expenses, utilities fee go on. Finally, in regard to parliamentary inspection, the 17th assembly has more accomplished inspection outcomes and less in-depth inspection than the 16th assembly. Overall, according to this study, it is found that the National Assembly has shown better effective and autonomous control on police budget decision processing than on legislative activities for police and has achieved the expected results in that the parliamentary inspection of police administration has outcome fruits.
