제조물책임법 개정 논의에 따른 제조물책임보험의 개선방안 연구

국문 초록

제조물책임법은 2002년 제정된 이후 12년이 경과한 현재까지 개정없이 시행되고 있으나 자동차 대규모 리콜 등에도 불구하고 입증의 어려움 등으로 인해 그 활용이 저조한 상태이다. 한편 제조물책임법 제정 당시에는 고려하지 않았던 생명공학기술을 이용한 농산물 등 신기술 내지 첨단 기술이 적용된 제조물이 등장하면서 이에 대한 책임 문제도 이슈가 되고 있다. 이에 따라 법무부는 공정거래위원회와 공동으로 제조물책임법 개정작업에 착수하여 개정안을 마련하였고, 입법예고 등을 거쳐 국회에 제출할 예정이다. 본 논문은 제조물책임법의 입법 배경과 그동안 국회에 제출된 개정안을 간략히 살펴보고, 제조물책임법의 개정 논의의 쟁점을 고찰하였다. 구체적으로 제조물 개념의 확대, 결함의 개념 정비, 손해배상범위의 확대, 입증책임의 완화와 관련된 쟁점사항을 설명하고, 해외 입법례와 비교를 통해 검토해 보았다. 제조물책임법이 개정된 후 소비자입장에서는 실효성 있게 구제 받고, 기업의 입장에서는 제조물책임으로 인해 과도한 비용을 지출하여 경영 위기에 처하지 않도록 하기 위해 제조물책임보험이 필요하다고 본다. 이에 본 논문에서는 제조물책임보험의 현황을 설명하고 제조물책임법의 개정논의 쟁점에 따른 제조물책임보험의 개선방안을 제안하였다.

영문 초록

After being enacted in 2002, Product Liability Law has been enforced for 12 years until now without amendment, but it is inadequately utilized due to difficulty with proof despite large-scale recall of automobile, etc. Meanwhile, due to arrival of high technology products that were not considered at the time of enacting Product Liability Law, such as agricultural products based on biotechnology, there are issues concerning the liability of these products. Therefore, Ministry of Justice, in association with Fair Trade Commission, began to work on revision of Product Liability Law and is planning to submit it to the National Assembly after prior announcement of legislation. This study briefly looks at the background of Product Liability Law and the revised bills submitted to National Assembly so far, and discuss issues regarding amendment of Product Liability Law. Specifically, issues related to expansion of the concept of product, revision of the definition of defect, range of product liability, and moderation of burden of proof will be explained and will be examined in comparison with laws in other countries. After amendment of Product Liability Law, product liability insurance seems necessary because consumers should be effectively helped and companies avoid risking management crisis after paying excessive costs for product liability. Therefore, in this study, current status of product liability insurance will be explained, and ways to improve product liability insurance are suggested including limited mandatory insurance for product liability, revision of insurance rate system, and revision of dispute settlement body other than the court.
