고령화 사회에서 부양의무에 관한 연구

국문 초록

고령의 노부모에 대한 부양의 문제에 대해서 통설은 민법 제 974조에서 그 근거를 찾고 있다. 이로 인하여 고령의 노부모에 대한 부양을 2차적 부양으로 이해하게 되면서 노부모에 대한 부양의 공백이 발생하게 되자 고령의 노부모에 대한 부양의 문제를 해결하기 위해서 부양의무자의 의무를 강화함으로써 노부모에 대한 부양의 문제를 해 결하자는 견해가 제기되고 있다， 그러나 핵가족회와 자녀의 부약의식의 약화로 인하여 부모가 자녀에게 부양을 받을 가능성이 점차 줄어 들고 있고 성년자녀 들의 노부모 부양에 대한 인식이 낮 아침에 따라 성년의 부양의무자에게 부양의무를 강화하는 것이 적절한 해결책이 되지는 못한다 세계적인 복지국가들이라 할 수 있는 북유럽의 여러 국가에서도 사적부양에서 공적부양의 강화로 제 도를 운영 해 오다가 다시 사적부양의 강화를 위한 방안을 모색하는 태도를 살펴 볼 때 우리도 사적부양을 강화하도록 하는 적절한 방법을 찾는 것이 합리적일 것이다 그렇다고 부양의무자에게 의무만을 강화하는 것도 변화된 가족의 형태로 볼 때， 적절한 방법은 되 지 못한다 또한 고령의 노부모들 역시 자녀에게 의지하기 보디는 자립할 수 있는 방안을 모색하는 방향으로 노후를 보내려 고 하는 경향이 높아지고 있다 따라서 이러한 여러 가지 시대 적 상황을 반영한다면 홀로 남은 배우자가 요부양상태에 빠지지 않도록 자력을 확보해 주기 위해서는 상속분을 강화하는 것이 합리적이며， 시대적 변화에 부응하는 적절한해 결방안이 될 것이다. 따라서 1990년에 신설된 「재산분할청구권」제도의 상속법에의 도입을 통해서 상속개시시에도 상속인인 고령의 생존 배우자에게 재산분할을 청구할 수 있도록 하여 혼인 생활 중 공동으로 형성한 재산에 대해서는 일차적으로 정산의 기회를 확보하여 자력 을 확보할 수 있도록 하고， 남은 상속재산에 대해서 공동상속인인 성년의 자녀들과의 상속재산 분배에 관한 문제를 해결해야 할 것이다.

영문 초록

Common view for supporting aged dependent is based on Civil Law, Clause 974. Under this common view, as support for the aged old parents is understood as a secondary support, vacuum of support for the old parents is created and as a result, in order to solve this problem for the aged parents, an opinion of solving the support problem for the aged parents by strengthening the obligation of the support obligators is dominantly prevailing but as possibility of receiving support from children by their parents is being decreased gradually due to nuclearization of family and weakened consciousness for supporting the parents by their children and recognition for supporting aged parents by children of full age is lowered, strengthening duty of support for the support obligators of full age does not provide a proper solution. In view of the fact that even in various countries of Northern Europe that may be called as global welfare states, they are now pursuing an initiative of strengthening private support systemagain while operating a system of strengthening public support instead of private support (in the past), it would be reasonable for us to look for an appropriate way of strengthening private SUPPOlt system as well. But just strengthening duty of support for the support obligators will not provide an appropriate solution considering transformed family pattern. In addition, aged old parents also are showing a high tendency of trying to spend their aged life by looking for a way of self-reliance rather than turning to their children for support. Therefore, given these various situations of the changing times, in order to provide spouse left as singlewith self-reliance so that he (she) may not be placed in a position requiring support, strengthening inheritance share may be reasonable as an appropriate way of satisfying change of generation. Therefore.by giving an opportunity of claiming property division light to the survived aged spouse, an inheritor, even at the time of commencing inheritance through introduction of a system of claim for division of matrimonial property newly established in 1990 in inheritance law, such spouse shall be arranged to secure self-reliance by primarily havingan opportunity of liquidation for the property jointly accumulated during matrimonial life and regarding remaining inheritance property, a problem of sharing such inheritance property shall be solved by the children of full age who are joint inheritors for such property.
