국문 초록

1세기 글로벌 거버넌스 측면에서 사이버공격은 한 국가의 전반적 사회기반에 치명적인 영향을 끼칠 수 있을 만큼 중대한 위협요인으로 등장하고 있다. 사이버공격이 국가테러리즘 등 특정목적과 결부될 경우에는 국가안전보장에 대한 위기를 초래할 수 있기 때문이다. 우리나라의 경우 2009년에 발생한 ‘7.7 DDos 대란’ 외에 2011년에만도 중앙선거관리위원회 홈페이지 사이버 테러 등 크고 작은 사이버보안 침해 사고가 발생하여 사이버위기의 엄청난 위험성과 그 대응의 필요성의 중요성을 깨닫게 해주었으며 사이버공격으로 인한 국가위기상황을 대처하기 위한 법제도적 조치를 시급히 마련해야 하며 사이버공격에 대해 공공부문과 민간부문의 전 방위적인 협조와 지속적인 노력을 통해 합리적 해결책을 도출해야 한다는 중요성이 부각되었다. 이에 본 연구에서는 사이버테러의 위협에 대한 인식을 제고하고 사이버테러에 대응하기 위한 발전방안을 제시하였다. 첫 번째로 법률적인 측면에서는 형법과 기타 여러 법률에서 규제하여, 종합적이고 체계적이지 못하는 현 상황에서 명확한 법적근거를 마련하기 위하여 기존 단속법령을 체계화하며 더불어 처벌규정 역시 정비하여 효과적인 법집행이 이루어질 수 있도록 하여야 한다, 두 번째로 테러대응을 위한 신속한 위기관리 시스템 확립이 필요하다. 테러예방을 위한 사전정보수집 및 위협분석 그리고 위기처리 특별전담반을 평상시부터 편성, 훈련시켜 오다가 테러발생시 에는 테러상황에 적합한 정책모형을 신속하게 결정하고 위기관리시스템을 가동할 수 있도록 잘 훈련되어 있어야 한다. 세 번째로 사이버 관련 조직과 인력을 통합관리하고 각종 법령체계를 지속적으로 보완 정비해나가야 하고 또 이와 연계하여 국방차원에서 새로운 안보위협에 효과적으로 대응하기 위한 정보전 수행능력을 강화하여 적의 전쟁수행능력과 의지를 사전에 마비시켜 신속하고 효율적으로 전쟁을 종결하려는 능동적인 전략으로 변화되어야 한다. 마지막으로 현실적인 국제공조의 어려움을 감안하여 각국의 입법동향이나 국제조약 체결 등을 활용하여 초국가적인 사이버테러에 대응할 수 있어야 한다.

영문 초록

In this thesis, countermeasures cyber terror was studied which produce social confusion and threats national security by making major information infrastructure mis-work, be hamstringed, and be broken through electronic attack such as hacking and computer virus dispersion by individuals, terror groups, or hostile countries that have specific political or social purposes. In the aspect of the 21st century governance, because cyber attack can have fatal influence on general social base, it comes up to the surface as the critical threat elements. In the case that cyber attack is connected with a specific object such as national terror, it is because it can cause the crisis against national safety insurance. As for korea, namely ‘7.7 DDoS disturbance’ has us recognize cyber crisis’s huge and necessity to threat it properly and also, treatment on the level of legal system should be rapidly prepared to take step against national crisis condition by cyber attack, in which the importance to find out reasonable solution is solidly appeared through full-ranged cooperation and consistent effort in public section and private section as well. Based on study, measures for development against cyber terror were suggested as follows: Firstly, in the legal aspects, it must be able to make the effective law enforcement available by regulating it in the criminal law and other various laws, and systemizing the existing control statues alone with reorganizing the punishing regulations also so as to prepare definite legal ground and to remove the incompleteness of control act at current situation which is not synthetic and systematic. Secondly, korea also needs crisis management systems to respond cyber terror without delay. Korea should collect information, carry out threat analysis, and run special task force teams on cyber terror in advance during peacetime and when cyber terror attacks. Korea should determine the appropriate policy models and operate crisis management system promptly. Thirdly, in order to manage cyber war capability, develop cyber warfare technology and come up with an appropriate legal system. Lastly, korea needs the sharing of information about cyber terror with other countries. Because the techniques of international cyber terror-related information is an important key to response to the international cyber terror efficiently.
