장애인차별금지법에서 교육차별에 대한 고찰과 이행과제

국문 초록

이 연구는 장애인차별금지법에서 장애아동의 교육차별에 대한 고찰과 앞으로 이행과제를 제시하는데 목적이 있다. 지난 3년간 장애인차별금지법이 시행되었지만 국가인권위원회의 2010년도 교육부부분에서 장애인차별 진정사건의 유형을 살펴보면 수업·시험평가 편의제공 부분(12건, 21.8%)과 시설물 접근 및 이용, 기타(11건, 20%) 순으로 나타났다. 장애인차별금지법 제13조와 14조의 교육차별금지 및 정당한 편의제공 의무를 중심으로 문제점을 제시하면 다음과 같다. 첫째, 교육책임자의 역할 및 책임의 한계 등에 관한 정당한 편의의 구체적인 이행 규정이 제시되어야 한다. 둘째, 법에서 제시한 교육기관에서 물리적 편의지원, 교수-학습지원, 보조원 배치, 취업 및 진로지원 등에 관해 지원체계 구축 수준이 학교가 자체적으로 수행할 수 있는 한계라는 점을 인식하고, 국가차원의 지원과 재정확보가 필요하다.

영문 초록

The purposes of this study are to consider disabled children’s educational discrimination in the law of prevent discriminating the disabled and suggest the future’s tasks. The law which prevents discriminating the disabled has been fulfilled for 3 years, but if examining forms of petitions discriminating the disabled in the section of 2010’s Education Ministry of National Human Rights Commission of Korea, it showed the part of convenience provision for classes·tests evaluation (12 matters, 21.8%), approach and using of facilities and others (11 matters, 20%) in order. The problems can be suggested as followed, focusing on prevention of educational discrimination and duty of providing proper convenience in Article 13 and 14 of the law which prevents discriminating the disabled. The first, the regulation for concrete fulfillment of proper convenience for roles of people in charge of education, their limitation of responsibilities, etc. must be suggested. The second, educational institution suggested in law must recognize that the standard establishing support system is a militation that school can fulfill by themselves for physical convenience support, teaching-studying support, supporter arrangement, employment and career support, etc. And, they also must secure support and finance of nation.
