국문 초록

민간경비(Private Security)란 여러 가지 위해로부터 개인의 이익이나 생명 및 재산을 보호하기 위하여 특정한 의뢰자에게 경비 및 안전에 관련된 서비스를 사람들로부터 받은 보수만큼 행하는 개인 및 단체 그리고 영리기업을 말한다. 민간경비는 사회범죄와 사회불안 요인에 근거하여 시민의 안위욕구에 대한 부응과 경찰력의 보완 또는 대체방법으로서 사회적으로 정착하며 발전하기 시작하였다. 특히 사회불안요인이 가중되어 나타나는 현대사회에서는 포괄적인 사회치안 및 질서유지를 담당하는 경찰력보다는 사적(私的)인 계약관계에 의해 개인의 안전이 보호되는 민간경비에 대한 의존현상이 증가되는 추세이다. 경찰을 비롯한 국가공권력이 충족시길 수 없는 국민들의 민간조사에 대한 수요충족이라고 하는 관점과 외국계 민간조사업계의 국내 진출 등을 고려할 때 민간조사업 제도의 도입 입법화를 적극적으로 도입할 때라고 본다. 이인기 의원이 대표발의한 경비업법 개정안은 국민들이 사실관계 조사가 필요하더라도 전문성과 시간적 제약으로 인한 한계 등 본인들이 할 수 없기 때문에, 이러한 일들을 국가자격을 취득한 전문가인 민간조사관에게 사실 조사서비스를 맡겨서 사생활 침해도 방지하고 영업의 적정성도 도모하고 민간조사업을 건전하게 육성시키기 위해서는 관련입법이 필요하다는 취지에서 나온 것으로 볼 수 있다. 민간조사제도에 대한 우리 사회구성원의 인식은 민간조사제도의 필요성을 인정하면서도, 민간조사원의 전문성 결여와 자질 문제를 들며 아직도 부정적 평가를 하고 있다. 그러나 이러한 민간조사인력의 전문성 결여와 자질문제를 해결하기 위해서는 민간조사 분야를 양성화함과 동시에 국가가 공인하는 전문자격제도를 도입해야 한다고 본다. 아울러 우수한 민간조사인력 양성을 위해서는 4년제 대학교 단위의 관련학과 설치 및 교육이 뒷받침되어야 한다.

영문 초록

Private Security is an individual, party and commercial company that do service related Security and safety to a client as mush as reward from people to protect private profit or life and property from many hazard. Private Security began to daielop as complement or atternation way socially settle doon for suit of safety desire of citizen and police power replation based on social crime and society apprehension, Especially mordern society that added society apprehension trend increase of depend on Private Security that protect individual safety by private inclusively society security and regularity keeping. A point as demand sufficiency for private investigation of people that national authority such as police can not sufficient and when consider that foreign private inverstigation business come into our country, it is time that positively induce regalization of private investigation business system. Security business law amendment which represent suggestion by Lee, ingi congress man, even if people need fact relationship investigation, because owing to the limitation specialty and time, people can not investigate, to national authority expert private inverstigator leave these and protect privacy violation and contrive business propriety and can know coming out the menaning of relation regalization to bring up healthily private investigation business. The recognition of our soclety member for private investigate system accept necessity and still do negative appraisal with specialty defficiency of private investigator and temperament. But to resolve this specialty defficiency of private investigator and temperament, private investigation field must positive disposition, simultaneously induct expert quality system which is national certificate. And, to bring up excellent private investigators, must establish 4 years college school course and back up education.
