1. CONTENTS
(1) RESEARCH OBJECTIVES
The social concept of fee simple(land ownership) is closely related with the particularity of land. Land is the ground of human life as resources are adhered close to human beings throughout human history. Land thought can be a value judgement on land, and rightly, real estate has emphasis put on the system of land ownership.
If real estate science is aimed at improvements of human behavior as a systematic science, therefore it is then needed to inquire in the thought of land ownership in terms of land ownership.
(2) RESEARCH METHODS
To study the ways, of the related theses, publications and statistics released in Korea and abroad, they are theoretically reviewed and the materials are obtained from related references, the above is used by literature reviews and survey analyses to achieve the purpose of this study.
(3) RESEARCH RESULTS
Land law in Korea can be expressed as a word as a central idea of land ownership. Because the land has been constructed to emphasize the commodity of land, the land law is composed of land ownership, exchange value, as a commodity and a guarantee of dominant power.
Hence, in terms of efficient utilization of the use value of land, the central idea of land ownership has much prevented a guaranteed system of land utility power.
Now, we need to exploit the thought of land ownership in view of a religious philosophical dimension.
2. RESULTS
Human beings, whomever, are born on land, live their life on land, and in the end come back to the land.
Land is a space which provides continuous vital power to grow human life. The idea or philosophy on land has been historically changed, and has been differently formed according to inherent politics, economy, social thought and/or systems. Land is private property as well as a public good. In consideration of the characteristics of land ownership, the land ownership(fee simple), based on private ownership rights, should not be forgotten that public regulation has been imposed in case of the abuse of rights.
