영문 초록

  This article deals with legal issues concerning creditors" avoidance of fraudulent trusts that are formed by their debtors. After defining the meaning of the fraudulent trusts, the article argues that the avoidance of fraudulent trusts should be dealt with differently from the traditional avoidance of fraudulent conveyance both in respect of the avoidance of the acquisition of the trust property by the trustee and the acquisition of benefits by the beneficiaries. The point is that, unlike the traditional avoidance of fraudulent conveyance, the avoidance of fraudulent trusts should be focused on the avoidance of trust settlement (ie. the debtor"s transfer to the trustee), and thus that the avoidance of the distribution of benefits to the beneficiaries be dependent upon the avoidance of the settlement. The argument is based on the proposition that, due to the very dependent nature of beneficiaries" position within the trust, the beneficiary"s acquisition should not be as strong as, and thus be dealt with differently from, that of the re-acquirer fromthe acquirer of the property in the fraudulent conveyance. The article applies the sameproposition to the avoidance of fraudulent trusts in the more complicated situations, suchas where the trust is formed by co-settlors, where a bankruptcy proceeding is filed against the trustee and so on, and draws the conclusion that such proposition may be justified in such situations as well.
