영문 초록

The People,s Republic of China(PRC) is in international trade one of the major countries in the world and under influence of the Chinese character culture. Their laws have been affected by the Civil law system. All these countries have their own commercial arbitration system for the commercial dispute resolution. Commercial arbitration has been statutorily recognized as one of alternative dispute resolutions in China. China is making their own effort to internationalize and improve their commercial dispute resolution systems. China enacted a new arbitration law in 1995. These reforms adopted by China will be the model of dispute resolution and the commercial arbitration system for modernization and internationalization of other countries in Asia. However, due to only a recent transformation from communist economics to more open market policies, the Chinese are unfamiliar with some features of the commercial dispute resolution systems which interprets dispute resolution methods, or more specifically, a countries ability to pay. In this paper I tried to explain and survey various aspects of the into the effective strategy of korean trading companies for commercial dispute settlements with China.
