국문 초록

学校体育场馆向社会开放后，存在着来自于学校场馆设施、锻炼者自身机能、体育活动与项目和社会治安等方面的危险性与伤害事故发生的可能性；在学校体育场馆开放的情况下，社会、学校、第三方和参与者个人均为人身安全的保护主体；学校体育场馆向社会开放后发生人身伤害事故的损害赔偿责任的确定适用民事侵权法的过错责任原则，不适用过错推定原则。

영문 초록

The school stadium becomes open to the society, along came into being the possibility of dangers and injury accidents resulting in the equipment of the stadium, physical situation of the person involved, the characteristics of a particular activity and the public order. When the school stadium is open to the public, all are the main body of personnel security protection including the society, the school, the third party and the person involved. Under such circumstance, the possible accidents and injuries should be applied to the fault duty principle of the law of tort, instead of the doctrine of assumption.
