국문 초록

이 연구의 목적은 내용적으로 스포츠권에 대한 법규범(Rechtsnorm) 체계를 고찰하고, 분석된 스포츠권 법규범을 배경으로 국가의 책무성을 논하였다. 이러한 연구의 목적을 달성하기 위해 먼저, 스포츠권의 개념과 그 법적 규범체계에 대하여 분석하였다. 이 과정에서 스포츠 관계법의 특성과 법적 규범체계를 정의하였다. 또한 스포츠권에 대한 국가의 책무 범위와 그 당위성을 분석하였다. 논의 전개를 통해서 본 연구는 스포츠권에 대한 법적 규범체계가 기본권적 성격을 가져야 함을 제시하였으며, 이에 대한 국가의 책무 방향성을 제시하였다. 이러한 연구 주제를 수행한 결과 다음과 같은 내용을 도출하였다. 스포츠 관계법은 지원법적이고 진흥법적 특성을 가지므로 행정의 주체에 대한 법규범을 갖는다. 따라서 스포츠 법규범은 현실적으로는 행정주체를 대상으로 하는 규범임을 의미한다. 따라서 국민의 기본권적 법규범이 강화될 필요가 있다. 본 고에서는 스포츠 기본권의 개념을 누구나 스포츠에 자발적으로 참여하여 인간다운 삶을 추구할 권리이며 신체 및 건강상의 기본권적 권리로 요약하였다. 스포츠권이 기본권적 특성을 갖는다는 것은 헌법 해석을 통해서도 법리적으로 논증 가능하며, 해외에서는 이미 오래전에 스포츠권을 헌법에 보장하고 있기도 하다. 따라서 스포츠권은 법의 제정 및 개정을 통해 기본권으로 명시될 필요가 있으며, 이는 국가의 책무로서 법적으로 명확히 규정되어야 할 것이다.

영문 초록

The purpose of this study is to examine the normative system of the law (Rechtsnorm) of sport human rights in terms of content, based on the analyzed content, the country s responsibilities were discussed. To achieve the purpose of this study, first, the concept of sports human rights and its normative system of the law were discussed. In this process, the characteristics of sports-related laws and normative system of the sport law were defined. In addition, the scope of national responsibility for sport human rights and its justification were analyzed. As a result of discussing these research topics, the following conclusions were derived. Due to sports-related laws have the characteristics of a support law and a promotion law, they have the characteristics of having normative system of the law for administrative entities. Therefore, sports legal norms have a normative system targeting administrative agencies. Therefore, it is necessary to reinforce the basic sport human rights laws and regulations targeting the public. n this paper, the concept of basic sport human rights is summarized as the right to pursue a human life by voluntarily participating in sports, and basic rights in the body and health . It can be argued that the right to sports has human rights characteristics, and it can be argued with the laws of the constitution, and abroad, the right to sports was already guaranteed in the constitution for a long time. Therefore, sports rights need to be specified as basic rights through the enactment and amendment of the law, which should be clearly defined as a national responsibility.
