범죄피해 외상자의 형사절차 및 법률지원에 따른 심리적 경험에 관한 질적 연구

국문 초록

본 연구의 목적은 범죄 피해 외상으로 심리치료를 받는 대상자의 형사절차 및 법률지원에 따른 심리적 경험을 파악하고, 이를 토대로 효과적인 지원방안을 모색하는데 있다. 이를 위하여 스마일센터에서 성폭력 등폭력피해로 심리치료를 받는 6명을 대상으로 심리치료를 통한 경험과 더불어 재판결과, 형사절차(수사 및재판과정), 법률지원에 대한 4가지 질문을 가지고 일대일 면담을 시행하였고, 이를 질적 사례연구 방법으로분석하였다. 그 결과, 심리치료과정의 심리적 경험은 20개의 의미단위, 9개 하위범주, 3개 상위범주로 분석되었으며, 상위범주는 ‘심리치료 전 부정적 경험’, ‘도움이 되었던 치료과정’, ‘심리치료의 효과’로 분석되었다. 재판결과에 따른 심리적 경험을 분석한 결과, 17개의 의미단위와 7개의 하위범주, 3개의 상위범주로 분석되었으며, 상위범주는 ‘만족스러운 재판결과가 주는 긍정적 경험’, ‘불만족스러운 재판결과가 주는 부정적 경험’, ‘재판결과 전의 힘든 심리적 경험’이었다. 형사절차(수사 및 재판과정)에서의 심리적 경험을 분석한 결과, 21개 의미단위, 9개 하위범주, 3개 상위범주로 분석되었다. 상위범주는 ‘과정이 주는 괴로움 경험’, ‘심리적 괴로움 경험’, ‘정의구현에 대한 기대’인 것으로 나타났다. 법률지원과정에 따른 심리적 경험을 분석한 결과, 17개 의미단위, 6개 하위범주, 3개 상위범주로 분석되었으며, 이 과정은 ‘유용성 경험’, ‘심리적 도움 경험’, ‘약간의 부담감’이라는 상위범주로 설명될 수 있음을 확인할 수 있었다. 본 연구는 범죄피해 외상자의심리치료과정에서 형사절차 및 법률지원의 중요성과 피해자의 심리적 안정과 회복을 위한 효과적인 지원방안의 필요성을 제기하고 논의하였다는 점에서 의의가 있다.

영문 초록

The purpose of this study is to understand crime trauma victims’ psychological experience from criminal procedure and legal assiatance. Based on this understanding, this study examines effective support measures. To this end, six victims of violent crime (including sexual violence) victims that are going through psychotherapy at the Smile Center were interviewed with four questions related to psychotherapy experience, trial results, criminal procedures, and legal assistance. Results from the interviews were analyzed through qualitative case study method. As a result, psychological experience from psychotherapy process was analyzed in twenty semantic units, nine sub categories, and three upper categories. Three upper categories were ‘negative experience before psychotherapy,’ ‘treatment process that was helpful,’ and ‘effect of psychotherapy.’ Analysis of psychological experience according to trial result showed seventeen semantic units, seven sub categories, and three upper categories. Three upper categories were ‘positive experience from satisfying trial result,’ ‘negative experience from unsatisfactory trial result,’ and ‘uneasy psychological experience before release of the trial outcome.’ Analysis of psychological experience from criminal procedures revealed twenty-one semantic units, nine sub categories, and three upper categories. The upper categories in this case were ‘suffering from the process,’ ‘experience of psychological pain,’ and ‘expecting justice.’ Analysis of psychological experience from legal assistance process showed seventeen semantic units, six sub categories, and three upper categories. This segment of the analysis could be explained by three upper categories—’experience of effectiveness,‘ ’experience of psychological support,‘ and ’some pressure.‘ This study is meaningful because it suggests the importance of criminal procedures and legal assistance in the process of the victim’s psychotherapy. In addition, it is meaningful because it suggests the need for an effective support mechanism for the victim’s psychological stabilization.
