교정시설 내 상주(常住)종교위원 도입 고찰

국문 초록

본 연구의 목적은 우리나라 교정시설 내 상주종교위원제도 도입을 위한 시론적 연구로 UN만델라규칙, 영국, 독일 등 6개 선진국가의 형집행법령상 종교조항을 추출ㆍ분석한 내용 중심으로 비교 분석ㆍ평가하여 종교가 교정시설에서 오랫동안 함께 한 교정프로그램이었는데 왜(Why) 괄목할만한 성과가 없었는지 성찰의 계기로 삼아 수용자의 종교처우 방향을 새롭게(new) 디자인하고자 고찰하였다. 우리나라는 유럽ㆍ미국에서 시행하고 있는 ‘교목(矯牧, 교회사)제도’가 1950년대 까지 유지하였으나 1960년대 이후 폐지된 이래 이에 대한 논의나 연구가 거의 없었다는 점이다. 연구한 내용 결과물을 정리하면, 첫째로 상주종교위원제도의 도입을 위한 전제로 교정관련 종교법령의 재정비가 필요함을 촉구하였다. 둘째, 우리나라 교정시설 가운데 여건과 환경이 부합되는 교정시설부터 시범적으로 성직자상주제도를 도입, 평가하여 전 교정기관에 실시할 것을 강조하였다. 셋째, 교정프로그램의 전문화는 교정인력 전문화와 함께 범죄자의 재범위험성을 관리하는 측면에서 매우 중요한 문제라고 보기 때문에 특정종파가 아닌 종교학 내지 종교상담학 전문요원을 채용하여 배치ㆍ육성할 것을 제언하였다. UN에서 권고ㆍ승인하고 있는 넬슨 만델라규칙에서 종교위원 상근제(full-time basis)의 국제기준 근거를 찾아 논의를 전개하였다는 점에서 본 연구의 의의를 찾을 수 있을 것이다. 미국의 경우 대형교도소에 상근 개신교 및 가톨릭을 운영하고 있다. 우리나라의 외국인수용자에 대한 종교 처우 현황과 실태 그리고 비교분석을 통하여 향후 후속적 연구가 ‘종교백화점’처럼 충분한 논의가 있기를 기대한다.

영문 초록

The purpose of this study is to compare and analyze the contents of the extraction and analysis of religious provisions in the law of execution of six developed countries such as UN Mandela Rules, UK and Germany as a theoretical study for introducing the resident religious committee system in the correctional facilities in Korea. In Korea, the ‘community (Church History) system’ implemented in Europe and the United States was maintained until the 1950s, but there has been little discussion or study since it was abolished since the 1960s. The results of the study are summarized as follows: First, it is required to reorganize religious laws related to correction as a premise for introducing the resident religious committee system. Second, it emphasized that the resident system of the clergy should be introduced and evaluated from the correctional facilities in which the conditions and environment are in line with each other in Korea. Third, since the specialization of the correctional program is considered to be a very important problem in terms of managing the risk of recidivism of criminals along with the specialization of correctional personnel, it was suggested that religious or religious counseling specialists should be recruited and arranged. It is necessary to examine the opportunity of reflection on why religion was a long-time correctional program in correctional facilities and why there was no remarkable achievement. This study is meaningful in that it has developed discussions by highlighting the basis of the full-time basis of the Religious Committee of Nelson Mandela Rules, which is recommended and approved by the UN and advanced countries. The guilty man writes this by introducing the legal adage that he is not forgiven unless he is corrected.
