사립학교 교원의 법적 지위에 대한 비교법적 고찰: 한국과 미국의 사례를 중심으로

국문 초록

본 연구에서는 사립학교 교원의 법적 지위와 관련하여 우리나라의 현행 법령상의 문제점을 지적하면서 미국 법령과의 비교분석을 시도하였다. 분석 결과, 첫째, 교육의 공공성과 사립학교의 공교육기관에 대한 인식은 있지만 아직 ‘공공서비스’를 법적 개념으로 인식하는 단계에 있지 않다. 둘째, 사립학교 교사의 법적지위와 관련하여 현행 법규범은 미국과 법적 지위 형식면에서 공직자로서 지위 강조라는 점에서 유사하나 기본권 제한을 포함한 법적 지위 형식과 내용은 법적 지위 내용에 있어서는 큰 차이가 있다. 셋째, 미국의 사립학교는 운영의 자율권을 확실히 보장받고 있지만 연방정부, 주 정부 등으로부터 재정지원을 받는 부분에 대해서는 재정지원자의 통제 하에 놓이게 된다. 이러한 분석 결과를 바탕으로 다음과 같은 시사점 및 개선 과제를 도출하였다. 첫째, 미국과 달리 자유주의적 전통이 약한 우리나라는 미국과 유사한 관점에서 교육을 바라보거나 사립학교의 공교육기관성을 인정하면서 사학조성에는 찬성하되 통제에는 반대하는 조류가 증가하고 있다. 둘째, 교원지위에 관한 모법으로서의 단일 법전의 제정이 요구된다. 셋째, 사립학교 교원의 임용에 관하여는 별도의 법률을 제정할 것이 아니라 원칙적으로 근로기준법의 규정에 의하여 법인과 교원 간의 대등하고 자유로운 사법상 고용계약에 의한 임면이 이뤄지도록 관련 법률을 개정하여야 한다.

영문 초록

In relation to the legal status of private school teachers, I sought to review the legal status of teachers, the legal status of private school teachers, the legal status of teachers, and the legal status of the private school teachers, and to review the legal status of the private school teacher and the status quo. Analysis results are as follows. First, public awareness of public education and public educational institutions in public schools is not yet recognized as a legal concept. Second, legal status and legal status Legal status and content of legal status, including basic rights, vary considerably in terms of legal status. Third, American private schools are guaranteed to ensure the autonomy of operations, but are placed under the control of financial support under the control of the federal government, state government and the state. Private schools in the United States also play an important role in historical traditions and prestige. Based on these analysis results, the following implications were derived from the following implications :First, unlike the United States, Korea, which promotes liberal tradition of liberal traditions, is in favor of education in the United States, recognizing education in a similar way to the United States and recognizing the public educational institutions in the private sector. That is, the education is related to the existence of the community and is not allowed to be completely neglected in the private sector. Second, it is required to enact a single code of law concerning the status of teachers as a teacher. Moreover, the formal legal status of a formal public school teacher should be lumped together with the same. Third, it is necessary to revise the relevant laws on the basis of a separate legal contract, not to legislate on the basis of a separate law.
