영문 초록

The semiconductor chip is one of the most significant technological innovations of this century, Few inventions have so singularly transformed our economy and personal lives. Semiconductors are, as steel once was, the base on which in dustries will be built, and advanced countries therefore regard their development and control as indispensible elements of new industrial revolution and of national security. The semiconductor industry has flourished in the United States, where fierce competition, spurred by antitrust regulations, has led to rapid technological progress. As profits have become more marginal, however, the continued well-being of America s semiconductor industry has become started to replace competition, and the industry has demanded and recently received-special legal protection of innoavtion, the lifeblood of the semiconductor trade. Traditional property laws have often criticized as neither adequately protecting electronic technology nor encouraging innovation. Patent monopolies, the protection granted to inventors for thier discoveries, require standards of inventiveness too high for most semiconductor chips. Copyright protection, which requires not inventiveness but merely originality, customarily applied only to works of authorship and not to machines or useful articles. Recently, however, a circuit court has upheld the copyrightability of firmware, which are written computer programs stored on chips, thereby blurring the once clear distinction between writings and machines. Thus, there is confusion concerning whether the chips themselves may properly be copyrighted or whether, like other unpatented products, they may be copied down to the last detail and competitors. The question has been brought to both judical and legislative forums, and Congress has recently responded to the chip piracy problem by enacting the Semiconductor protection Actof 1984
