집회 현장에서 경찰의 차벽 운용에 관한 고찰

국문 초록

2011년 6월 헌법재판소에서 경찰이 설치한 차벽의 위헌결정으로 인해 집회현장의 차벽 운용에 대해 논란이 되고 있다. 헌법재판소에서는 차벽에 의한 전면적이고 극단적인 통행제한조치에 대해 덜 제한적인 수단에 의해 공공질서 유지의 공익적 목적을 달성할 수 있었던 상황에서 차벽을 활용한 전면적인 통행제한조치는 과잉금지원칙에 위배되며, 차벽을 활용하기 위해서는 급박하고 중대하며 명백한 위험이 존재할것과 그럼에도 침해의 최소화를 위한 조치가 필요함을 강조하고 있다. 법원에서는 세월호 집회시 시위대의 차로점거를 방지하기 위해 경찰이 설치한 차벽이 헌법재판소가 제시한 차벽 설치의 조건과 한계를 충족하여 적법하다고 하는 등 불법집회·시위에 대해 경찰의 차벽 설치를 정당화하는 판결을 하고 있다. 경찰은 2002년 노무현 정부 시대부터 차벽을 운용하기 시작하였고, 현재에도 활용하고 있다. 이는 집회참여인원이 많아짐에 따라 시위대와의 충돌을 방지하여 인명피해를 최소화하기 위한 불가피한 경찰 자체적인 집회관리정책의 변화로 보이나, 차벽설치의 법적 근거에 대해 집시법상 질서유지선인지 여부에 대한 논란이 있다. 질서유지선은 합법적으로 신고된 집회에서 절차를 준수해서 고지해야 하며 집회보호를 위해 설치되어야 하는 등 문제점이 많으며, 오히려 경찰관직무집행법 제10조(경찰장비의 사용 등) 등이 근거가 될 수 있을 것이다. 국민의 집회자유권을 보호한다는 점에서 집회현장의 차벽설치는 최대한 자제 하는 것이 바람직하며, 불가피하게 설치하는 경우에도 급박하고 중대하며 명백한 위험이 존재하고 다른 수단에 의해서도 공공질서 유지가 어려운 경우 최소한의 범위에서 설치하되, 설치가능한 세부적 상황을 7가지 제시하였다. 차벽설치의 경우에도 일반인의 통행을 위한 통행로는 반드시 확보하여 침해의 최소화를 위한 조치가 병행되어야 할 것이다.

영문 초록

As the Constitutional Court made a decision of unconstitutionality against the vehicle-wall-blocking by the police in June 2011, the vehicle-wall-blocking at assemblies is becoming a controversial issue. The Constitutional Court accentuates that the full-scale and extreme passage reservation by vehicle-wall-blocking at the circumstance where less-restrictive measure may achieve the public order violates the principle of excess prohibition, and the Constitutional Court also accentuates that the vehicle-wall-blocking shall be used only to minimize violation in a urgent and serious condition by taking a clear risk. Even with the decision by the Constitutional Court, the court still justifies the installation of vehicle-wall-blocking by the police to interfere illegal assembly/protest of Sewol Ferry Assembly. The police began to use the vehicle-wall-blocking from the era of Roh administration in 2002 until now. Although it may seem to be the unavoidable policy of assembly management by the police to minimize casualty by preventing the impact with demonstrators, it is controversial whether this is the moderate boundary for the maintenance of order under the law on assembly and demonstration and is under the legal basis of vehicle-wall-blocking. The boundary for the maintenance of order shall be made at the legal assembly under the procedures, and it shall be actually installed to protect the assembly, followed by the bases from the Act on the Performance of Duties by Police Officers Article 10 (Use of Police Equipment, etc.). In perspective of protecting the freedom of assembly of people, the vehicle-wall-blocking at assemblies shall be refrained as much as possible, and in some unavoidable circumstances, it shall be installed at the minimal range with a risk when the public order is difficult to be maintained, in accordance with the seven detailed occasions where the vehicle-wall-blocking is acceptable. In case of installation of vehicle-wall-blocking, the measures to secure the path for pedestrians shall be made to minimize infringement.
