신상공개 대상자들의 제도수용태도 유형분류와 영향요인 검증

국문 초록

본 연구의 목적은 신상공개 대상자들이 동제도 수용여부 및 제도인식을 살펴보고 제도수용태도의 잠재계층을 파악하여 그 특성에 따라 유형화하며 이러한 유형분류에 영향요인을 검증해 보는데 있다. 신상공개제도에 대한 관심이 매우 높은 것과는 대조적으로 제도대상자들에 대한 실증연구가 매우 부족하다는 점과 제도수용태도의 다양한 유형 및 유형별 특성 파악이 전혀 이루어지지 않았다는 선행연구의 한계를 인식하여 이 연구가 수행되었다. 연구자료는 보호관찰소에서 실시된 신상공개명령을 받은 성범죄자들에 관한 설문조사를 활용하였고, 이들의 제도수용태도를 잠재계층분석을 통해 유형분류하고 영향요인을 검증하였다. 연구결과, 신상공제도의 수용태도는 제도의 긍정적 측면을 다소 수용하지만 수치심과 낙인효과를 강하게 인식하는 유형 1, 제도의 긍정적 측면을 수용하지 못하고 부정적 효과만을 강하게 느끼는 유형 2, 그리고 제도의 긍정적 기능은 다소 수용하면서 부정적 효과는 강하게 인식하지 않는 유형 3의 세 가지로 나타났고, 이러한 유형분류에 영향을 미치는 요인으로는 수사재판과정에서의 부정적 경험과 방어권 보장에 대한 의견, 그리고 결혼상태 등으로 나타났다.

영문 초록

In Korea, registration and notification policy on sex offenders are among the mostly widely discussed and debated policies with electronic monitoring system for sex offenders. Even though public's view and perception on the notification policy are described as valuable and important for public safety and the right to know for the public, there is lack of data regarding how sex offenders perceive and value this policy which they are subject to. In particular, previous studies on the perception on the policy are heavily focus on the public's viewpoint, and sex offenders who are subject to the registration and notification policy are rarely examined for their perception and attitudes on the policy. In addition, previous studies focusing on the sex offenders' perception on the policy did not examine different types on the attitude and perception on the policy. Using latent class analysis, three types of perception and attitude toward registration and notification policy are examined and classified based on their characteristics. The classification of sex offenders' perception on the registration and notification police include (1) strongly perceive policy's negative impact on the offender with minor acception on the purpose of the policy, (2)strongly perceive policy's negative impact on the offender with no acception on the purpose of the policy, and (3)perceive neither negative impact nor positive perspective of the policy.
