보호감호수용자 처우 향상방안

국문 초록

대한민국의 보호감호제도는 전형적인 보안처분제도로서 1980년 신군부의 집권 과정에서 사회보호법으로 입법화되었으며, 형법상의 이중처벌의 금지 위반 여부 등 보호감호제도 자체의 문제점과 보호감호자 처우 등 집행자체의 범죄예방정책국이나 교정본부 소관이냐의 현실적인 문제점과 제정 당시부터 많은 인권침해의 논란의 문제가 있어 왔다. 이러한 논란은 사회보호법이 2005년 폐지되었으나, ‘사회보호법 폐지법률’ 이 시행되기 전에 확정된 보호감호 판결의 효력은 그대로 유지하도록 규정함으로써 13,413명의 보호감호자들이 집행을 받고 출소한 상태에서 2012년 11월 현재 경북제3교도소와 천안교도소에는 이른바 보호감호자들이 현재 경북북부3교도소에102명 천안교도소에 30명이 현재 형 집행중인자로서 교정시설에 대기 중인 보호감호자가 115명으로 수용생활을 하고 있는 실정이다. 사회보호법은 폐지되었으나, 아직까지도 풀리지 않은 실타래처럼 남아 있는 것이 이 시대의 보호감호자정책의 딜레마이자 현안과제가 바로 사회보호법에 의한 보호감호자에 대한 처우제도이다. 아직도 후유증이 사라지지 않고 있는 것이 바로 사회보호법으로써 사회보호법의 문제와 필요성에 대해서 살펴보고자 한다.

영문 초록

The protective custody system of Korea is a typical security measure, enacted as Social Protection Act in the process of seizing power by the new army group in 1980, which there have been disputes over its own problems like whether it violates the prohibition of double punishment in criminal law, practical problems like whether its execution like the treatment of people in protective custody is under the jurisdiction of the Criminal Prevention Policy Bureau or Correctional Service, and problems of human rights infringement since its enactment. With these controversies, the Social Protection Act was abolished in 2005; however, by providing that the effectiveness of protective custody ruled finally before the execution of ‘Act on the Abolition of the Social Protection Act’ should remain intact, so while 13,413 persons in protective custody were executed and released from prisons, as of November 2012, so-called people in protective custody are still put in jail(102 in Gyeongbuk Bukbu 3 Prison and 30 in Cheonan Prison) and 115 persons in protective custody waiting at corrective facilities are committed in punishment execution. The fact that the Social Protection Act was abolished but still remains like a skein of thread not yet unraveled is a dilemma of the protective custody policy at this time and its pending issue is the system of treating people in protective custody by the Social Protection Act. Its aftereffect has not yet gone, so its problems and necessities will be examined.
