교정시설의 감염병 관련 취약점과 개선방안에 대한 고찰

국문 초록

코로나19 대유행은 교정시설 보건과 지역사회 보건이 결코 분리할 수 없는 관계라는 인식을 증가시켰고사회정의, 공중보건 및 인권 측면에서 간과되어온 부분들에 대한 검토 필요성을 제기했다. 본 논문은포스트 코로나 시기로의 전환을 준비하는 현시점에서 대유행 기간 드러난 교정시설의 감염병 관련취약점을 토대로 교정시설 및 지역사회의 보건 개선과 교정시설 내 건강과 인권의 균형적 공존을위해 지속 가능한 개선방안을 제시하고자 한다. 첫째, 코로나19 감소에 가장 효과적인 방법으로 알려져있는 과밀수용 완화를 위해 장기적 측면에서 구속 자제를 위한 효과적인 정책이 도입되어야 한다. 둘째, 교정인구의 노령화와 높은 만성질환 유병률을 감안하여 지역사회 고위험군에 준한 백신 우선접종, 선별검사를 통한 적극적 차단 조치가 반드시 제공되어야 한다. 셋째, 환기 개선과 정신건강 문제완화를 위해 교정시설 건축구조에 대한 재검토가 요구되며 적정 기준이 마련되어야 한다. 넷째, 교정시설의 고질적인 자원 및 정보부족 문제 개선을 위해 충분한 방역물품 확보, 지역사회 의료체계와 연결확대, 원격의료시스템 확충, 수용자에 대한 정보제공 개선이 필요하다. 다섯째, 방역을 위한 장기적제한조치는 수용자의 심리상태를 악화시키고 존엄성 침해 위험을 높이므로 가족, 변호인, 의료진에접근할 수 있는 최소한의 자원이 확보되어야 한다. 여섯째, 코로나19 대유행과 관련하여 직원 부재상황에 대한 대비, 직원에 대한 정서적 지원 방안 마련이 필요하다.

영문 초록

The COVID-19 pandemic has increased awareness of the inseparable relationship between prison health and community health, and has raised the need to review social justice, public health and human rights. This paper aims to propose a sustainable improvement plan for the balanced coexistence of health and human rights based on the infectious disease-related vulnerabilities of correctional facilities revealed during the COVID-19 pandemic. First, in order to alleviate overcrowding, an effective policy for restraining incarceration in the long-term should be introduced. Second, considering the aging population and the high prevalence of chronic diseases, it is essential to take proactive measures to block the virus through preferential vaccination and screening. Third, to improve ventilation and alleviate mental health problems, close inspection of the architectural structure of correctional facilities is required, and appropriate standards must be prepared. Fourth, it is necessary to secure sufficient quarantine products, expand the connection with the local community medical system, expand the telemedicine system, and improve the provision of information to prisoners. Fifth, since long-term restrictions for quarantine deteriorate the psychological state of prisoners and increase the risk of violation of dignity, minimum resources for accessing family members, lawyers, and medical staff must be secured. Sixth, in relation to the COVID-19 pandemic, it is necessary to prepare measures for the absence of correctional facility staff and provide emotional support for them.
