칸트 철학에서 본 정의와 용서

국문 초록

이 논문은 칸트의 용서개념이 그의 도덕철학에서 독자적 위치를 확보하지 못하는 이유를 밝히고, 그의 정의개념과 충돌할 수밖에 없는 태생적 문제점을 지적하고자 한다. 칸트는 관용, 화해, 용서 등을 덕의무라고 규정하면서, 용서의 개념을 덕과 연결시킨다. 그리하여 용서개념이 덕의 강함이라는 도덕적 용기와 자연스럽게 결합되고, 칸트는 용서개념에도 ‘도덕적 용기’라는 개념처럼 ‘정당성을 자각하는 정신’이 내포하고 있음을 지적하지 않을 수 없게 된다. 그 결과 칸트의 용서개념은 정의의 요구에서 영원히 벗어나지 못하는 태생적 딜레마에 빠지게 된다. 칸트가 관용, 화해, 용서를 분명히 덕의무로 규정했음에도 이와 같은 개념들을 윤리학의 주제로 다루지 않았던 이유는, 구체적 상황이나 피해자의 의지가 용서의 문제에 결정적이어서 용서의 보편적 기준을 제시할 수 없기 때문이기도 하지만, 그의 용서개념이 정의의 요구에서 영원히 벗어나지 못하는 태생적 딜레마를 안고 있다는 점이 보다 결정적 이유였던 것처럼 보인다.

영문 초록

This paper explains why Kant s concept of forgiveness fails to secure his own position in his moral philosophy and points out the inherent problems that are bound to conflict with his concept of justice. Kant connects the concept of forgiveness with virtue, while he defines tolerance, reconciliation, and forgiveness as a duty of virtue. Thus, the concept of forgiveness is naturally coupled with the moral courage as strength of virtue, and Kant can not help but point out that the concept of forgiveness also implies ‘a spirit of awareness of justification’ like the concept of ‘moral courage’. As a result, Kant s concept of forgiveness falls into an inherent dilemma that can not be forever removed from the demands of justice. The reason why Kant hasn’t treated such concepts as the subject of ethics, even though he has explicitly defined tolerance, reconciliation, and forgiveness as a duty of virtue, is that concrete circumstances or the will of the victim are crucial to the question of forgiveness and can not provide a universal standard of forgiveness. But it seems more crucial that Kant’s concept of forgiveness has an inherent dilemma which can not escape the demands of justice forever.
