국문 초록

｢집합건물법」제8조는 “대지위에 구분소유권의 목적인 건물이 속하는 1동의 건물이 있는 때에는 그 대지의 공유자는 그 건물사용에 필요한 범위의 대지에 대하여는 분할을 청구하지 못한다.” 라고 하여 그 분할을 ‛건물사용에 필요한 범위의 대지’로 제한한다. 동조 제한과 관련하여 판례는 동조규정의 취지를 집합건물 존립의 기초를 확보하려는데 있다고 하거나, 구분소유자 공동생활관계의 보호를 들어 그 제한의 범위를 대지의 분할이 향후 전체대지의 이용가치, 즉 경제적 가치에 미치는 영향을 들어 확대하고 분할을 사실상 제한함으로써 구분소유자의 보호는 물론이고, 건물의 전유부분없는 대지공유자 또는 과대지분권자의 재산권 행사를 본질적으로 제한한다. 본고에서는 집합건물의 공유지분의 분할방법의 보완으로서 건물의 전유부분 없는 대지공자의 지분을 건물의 전유부분을 가지는 구분소유자의 1인 또는 수인에 분속하게 하고 그 지분을 취득하는 자는 그 지분의 가격을 배상토록 하는 가액정산을 명하거나, ｢집합건물법｣ 제7조의 구분소유권의 매도청구권의 원용을 법원이 적극 인용토록 함으로써 건물의 전유부분없는 대지공유자 또는 과대 지분권자의 재산권 행사를 보호할 것을 주장하였다.

영문 초록

When a building as the subject of divided ownership belonging on a Land Area, a joint owner of the Land Area, within necessary area to use the building, may not claim for it’s division.(Article 8. of the Aggregate Buildings Law ) states prohibition of separate disposal and the article 8. states prohibition of division within the scope of necessary to usually use. As to try to secure the basis of the existence of Aggregate building or for the protection of the communal living relationship between divided owners, is actually limited to partitioning of the land area by the precedents. so essentially restrict Land sharer’s exercise of property rights, who has no exclusively owned part or right of share excessively In this dissertation I insist, as a way of complementing, let another divided owner or owners, who have exclusively owned part, acquire shares of land sharer, who has no exclusively owned part and who acquired it compensate for the price. Or should be invoked a right to request the purchase of divided Ownership on the Article 7. of the Aggregate Buildings Law to protect the Land sharer’s exercise of property rights, who has no exclusively owned part or right of share excessively
