존 롤즈(John Rawls)의 공적 이성(Public Reason)과 관용(Toleration)의 한계

국문 초록

현대 민주주의 사회는 어떻게 상이한 권위주의체제에 속해 있는 구성원들이 하나의 입헌정체속에서 공존할 것인가의 문제를 안고 있다. 이는 필연적으로 사회 구성원들로 하여금 집단적으로 구속하는 결정들의 근거에 대해 관심을 향하게 한다. 그렇다면 그 근거들을 어떻게 만들 것인가와 어떻게 실현할 것인가의 문제가 수반되어질 수밖에 없다. 이를 결정하기 위한, 서로 양립할 수 없는 다양한 포괄적 교리가 공존하는 합당한 다원주의의 현실(the fact of reasonable pluralism)에서, 서로에게 합당하게 제시될 수 있는 이성으로서 롤즈는 공적이성(public reason)을 제시하였다. 공적이성은 질서정연한 입헌 민주 사회관(a well-ordered constitutional democratic society)에 속하는 것으로, 민주적 시민정신의 이상(the ideal of democratic citizenship)이다. 공적 이성은 자신 만의 정치적인 영역(the political)을 가지며, 헌법의 본질(constitutional essentials)과 기본적 정의의 문제(matters of basic justice), 그리고 이것과 관련되어 다루어야 할 문제들을 두 가지 도덕적 능력(two moral powers)을 기초로 사용한다. 시민들 사이의 공정성(fairness)과 존중(respect)을 현실화하기 위한 롤스의 기획은, 그의 합당성의 규정과 공적 이성 규칙의 설정이 여전히 사회의 포괄적 교리를 충분히 담지 못하도록 되어 있기 때문에, 신념의 갈등을 넘어 사회의 안정성을 온전히 담보하지 못하고 있다는 비판이 있다. 본 논문은 롤즈의 공적이성의 개념, 영역 그리고 규칙을 서술하고, 롤즈의 정치적 자유주의 기획이 포괄적 교리들을 충분히 담아내지 못하고 있기 때문에 불완전한 것임을 지적하고자 한다.

영문 초록

Modern democratic societies are faced with the serious problem of how people could establish cooperation and constitute principles of justice in the fact of reasonable pluralism. In order to make a stable and just society existing over time, free and equal citizens profoundly divided by reasonable comprehensive doctrines would seek to find a reasonable public basis of justification on fundamental political questions. For the ideal of democratic citizenship, John Rawls s public reason ,which presupposes separation between the political and the nonpolitical, is implemented to specify the priority of the right over the good. However this raises the question of dualism between identity based on the special nature of modern democratic society and identity originating from religious or nonreligious comprehensive doctrine. This is due to the proviso that Rawls intrinsically imposes on citizens as a moral duty when deliberating matters relating to constitutional essentials and basic justice. Rawls s public reason does not explain fully the reason why certain limitations are imposed to the freedom of speech. Thus this paper points out that not only the Rawls s reasonableness need to be more or less soft, but also the proviso has to be applied more specified way.
