국문 초록

한국의 가구 절반 이상이 임대차로 거주하고 있고 다변화 시대에 임차인의 거주요건 요구도 증가와 더불어 건축물의 노후화, 불완전한 계약서, 법률규정의 미비, 구두약속 입증의 어려움으로 많은 분쟁이 발생하고 있다. 이에 본 연구는 2012년부터 2017년까지 서울시에서 운영한 주택임대차 간이분쟁조정건을 분석하여 주택임대차분쟁조정에 미치는 영향요인을 분석하였다. 분석결과 조정성립에 미치는 영향요인으로 첫째, 운영요인군 중에서 조정방식이 유의 미한 것으로 나타났다. 이는 조정 주최기관의 역할과 방법이 중요하다는 것을 의미한다. 둘째, 환경요인군 중에서 분쟁유형이 유의미한 것으로 나타났다. 이는 신청인과 피신청인 양 당사자가 수용 가능한 분쟁유형과 범위안에서 조정이 가능하다는 것을 의미한다. 기존의 선행연구들은 법원의 판례 위주의 해석과 주택임대차분쟁조정위원회의 필요성만을 언급했으나, 본 연구는 행정기관의 조정 자료를 가지고 실증 분석하였다는 점에서 차별성을 가진다.

영문 초록

More than half of Korean households are residing in leases. In the diversification era, there is a growing demand for tenants residency requirements, and many disputes arise due to the aging of buildings, incomplete contracts, insufficient legal regulations, and difficulty of verbal promises. This study analyzed the factors affecting the settlement of housing lease disputes by analyzing the housing dispute settlement cases operated by Seoul City from 2012 to 2017. First, the adjustment method was found to be significant among operating factors. This means that the ole and method of the coordinating organ is important. Second, dispute types among environmental factors were significant. This means that both the Complainant and the Respondent are able to adjust within the type and scope of the dispute they are able to accept.The previous studies mentioned only the court precedent - oriented interpretation and the necessity of the housing lease dispute mediation committee. However, this study has differentiation in that the analysis is conducted with the coordination data of administrative agencies.
