근대정치사상과 인권 그리고 여성

국문 초록

근대정치사상에서 개인이 발견되었지만, 여기에 여성이나 사회의 소수집단이 존재하는지에 대해서는 명확하지 않다. 오히려 여성의 문제가 들어서면 사회의 전통과 관습을 내세우고, 사회의 통념과 감정을 근거로 들면서 이성중심적 계몽사상이 일탈적 이론 전개를 하는 역설적인 상황이 드러난다. 계몽사상을 통해서 서구를 중심으로 한 근대정치사상이 세계사적으 로 역사를 주도하게 되지만, 그 자체 내에 존재한 일관성 없음과 사상적 한계로 인해 이후 미완의 혁명이자 근대기획의 실패라는 도전에 직면하게 된다. 근대의 혁명가들은 인간의 보편적 권리와 존엄성에 대해 인정하였지만, 인간의 구체적 적용에서 발생하는 문제들에 직면하게 되었다. 유색인종이나 여성은 왜 시민적 권리를 부여받을 수 없었는지를 자유주의 사상으로 설명할 수 없었다. 보편적인 인간의 권리는 남성에게서만 구체화되었고, 여성에게서는 드러날 수 없었는지에 대해서도 자유주의 사상은 설명하지 않는다. 이와 같이 근대정치사상에서‘인간의 해방과 인간의 권리 확보’는 절대로 포기할 수 없는 핵심적 주장이지만, 여기에 여성이 과연 포함되어 있는 것인지에 대해서 프랑스의 인권선언이나 미국의 독립선언서도 침묵하고 있다. 혁명과 선언서 이후 제정된 미국 헌법에도 프랑스 국민의회나 국민공회 헌법에도 여성의 권리에 대한 언급은 존재하지 않는다. 선언서와 헌 법에 명시된‘인간’이나‘시민’에 여성이 과연 포함되는 것인지에 대한 논쟁을 해 볼 여지도 없이, 프랑스 혁명 당시 거리에서 인간의 권리를 외쳤던 여성들은, 미국에서와 마찬가지로, 혁명 이후 모두 가정으로 돌아가야 했다. 사회에서는 여성이 사라지고, 근대기획은 마무리되었다. 부분과 전체의 문제에서, 부분에 문제가 있을 때, 전체에 문제가 없다고볼 수 없듯이, 인간사회에서 여성의 인권에 결함이 있다면, 전체 인권에 결함이 없다고 할 수 없는 것이다. 인간의 해방을 기치로 내세운 근대기획의결과 여성이 사회에서 사라졌다. 여성의 존재가 고려되지 않는 인간의 해방이나 인권이 과연 제대로 된 개념일 수 있는지는 각해 볼 일이다. 근대 기획의 완성을 위해 절대적으로 요청되는 것이 있다면 바로 여성이다. 여성의 인권에 대한 고려 없이 인권을 말할 수 없는 것이다. 이 논문에서는 근대기획의 기폭제가 된 프랑스 대혁명기를 중심으로 여성의 인권문제를 집중적으로 다룰 것이다.

영문 초록

Even with discovering the individual in the modern political thought, it is not so clear whether women and social minority groups are included in its concept. We often see the paradoxical scenes in which the reason-centered enlightenment philosophy would rather try to explain women issues on the basis of the sentiment and the generally accepted ideas founded in the social traditions and conventions. Even though the western centered modern political thought come to lead the world history, it is faced with the claim that the modern project has not been accomplished and finally failed. It is basically due to its inconsistency and limitations. Even though the revolutionaries in the Modern period recognized the universal human rights and dignity, they come to encounter the issues derived from the reality. Liberalism cannnot theoretically explain why the colored and women have not acquired the citizenship. It does not explain why the universal human rights has not been manifested in women, either. Emancipation of human beings and assurance of human rights in the modern political thought cannot be denied as the core concept of ‘the Declaration of Independence’ in the American Revolution and ‘the Declaration of the Rights of Men and Citizens’ in the French Revolution. Thses two historical documents keep silent whether women are included in its concept of men or citizens. Even after establishing the government both in America and France, the constitutions have not mentioned women’s rights. All the women should be withdrawn back into the individual house. Women finally disappeared and the Modern project has completed. With the defects on women’s rights, we cannot claim no defects on human rights. At the point that women have disappeared in society with the completion of the modern project, we should reconsider whether human emancipation and human rights can exist with exclusion of women. For the completion of the modern project, women should be rediscovered and included. Nobody can say human rights without considering women. In this study, I try to rediscover and explain women’s rights in the period of the French Revolution as a trigger of the modern project.
