EU의 표준화 정책과 FTA에 대한 함의: 한-EU FTA와 한-미 FTA의 비교분석을 중심으로

국문 초록

WTO에서는 TBT 협정을 근거로 회원국 간 불필요한 무역장벽을 만들지 않도록 규정 하고 있다. 상이한 기술규정, 표준 및 적합성평가절차가 국가 간 상품의 자유로운 이동을 저해할 수 있기 때문에 이러한 모든 조치들을 국제 표준에 기초하여 사용하도록 정하고 있다. 최근에는 FTA 협상 및 체결이 확대됨에 따라 FTA 조항으로 무역기술 장벽을 해소할 수 있는 방안이 도입되고 있는 추세이다. FTA에 나타나는 합의 결과는 체결 당사국의 국내 정책에 기반을 두고 있으므로 무역기술장벽과 관련해서는 기술규정, 표준 및 적합성평가절차를 모두 포함하는 표준화 정책을 살펴볼 필요가 있다. 예를 들면, 한국과의 교역량이 많은 EU의 표준화 정책은 한-EU FTA 발효의 맥락에서 중요하다. EU의 표준화 정책은 old approach부터 시작하여 new approach를 통한 역내 표준의 조화를 거쳐 global approach를 적용한 유럽 표준의 국제표준화를 추진 하는 방향으로 발전하였다. 국제 표준에 기초한 조화를 중시하는 EU의 전략은 한-EU FTA 조문을 통해서 드러났다. 주요 분야인 전자제품과 자동차 분야에서 한국이 국제 표준에 기초하여 표준을 조화시키도록 하였고 적합성평가절차와 관련해서도 국제 표준에 기초한 적합성평가절차의 결과를 한국이 수용하도록 했으며 궁극적으로 유럽의 수준에 근접한 SDoC를 도입하는 데에 합의하였다. 이를 바탕으로 EU와 FTA를 체결할 국가들은 EU의 표준화 정책에 대응하여 자국 또는 지역 표준의 국제표준화 전략을 수립할 수 있다는 점을 시사하고 있다.

영문 초록

The WTO stipulates in the TBT Agreement that countries shall not create unnecessary obstacles to trade. Since differences in technical regulations, standards, as well as conformity assessment procedures create possibilities of preventing the free movement of goods, members have agreed to use international standards as a basis for these measures. Conclusions of FTAs are increasing as a strategy to facilitate international trade. Accordingly, measures to alleviate technical barriers to trade by means of FTAs are being increasingly implemented. There is a necessity to evaluate standardization policies that include aspects of technical regulations, standards and conformity assessment procedures considering that agreements finalized in the FTAs are based on the domestic policies of contracting parties. For instance, EU’s standardization policy is significant in regards to the effectuation of the Korea-EU FTA. The standardization policy of the EU evolved from the old approach through the new approach that harmonized standards within the region to the global approach that promotes the international standardization of European standards. EU’s policy which concentrates on harmonization based on international standards following the global approach was reflected in the articles of Korea-EU FTA. In the area of electronics and motor vehicles, Korea was required to harmonize its standards to the relevant international standards and in regards to conformity assessment, it was ultimately agreed that Korea implement the EU-type SDoC. Implications for countries that are expected to finalize an FTA with the EU are centered in the international standardization of national or regional standards to tackle EU standardization policy.
