국문 초록
헌법 제12조 제3항은 「체포・구속・압수 또는 수색을 할 때에는 적법한 절차에 따라 검사의 신청에 의하여 법관이 발부한 영장을 제시하여야 한다. 다만, 현행범인인 경우와 장기 3년 이상의 형에 해당하는 죄를 범하고 도피 또는 증거인멸의 염려가 있을 때에는 사후에 영장을 청구할 수 있다.」고 규정하고 있으며, 형사소송법 제202조(사법경찰관의 구속기간)는 「사법경찰관이 피의자를 구속한 때에는 10일 이내에 피의자를 검사에게 인치하지 아니하면 석방하여야 한다.」고 규정하고 있다. 검사의 경우도 동일하며, 다만 동법 제205조에 따라 10일을 초과하지 아니하는 한도에서 구속기간의 연장을 지방법원 판사에게 신청할 수 있다.
그런데 작년에 발생한 감염병 예방 및 관리에 관한 법률에 따라 제4군 감염병으로 분류된 메르스 확산 사태 등과 관련하여, 피의자가 구속 상태로 감염병 환자나 격리대상자로 지정되어 장기간 격리될 경우 구속피의자에 대한 구속기간의 도과로 인하여 수사절차상 중대한 문제가 발생할 수 있다. 따라서 별도의 ‘격리유치장’을 발부받거나, 판사의 허가를 얻어 ‘감염병에 대한 완치 또는 미발병 사실 확정시까지’의 기간을 구속기간 불산입하는 방안을 고려해 보아야 할 것이다. 문제는 전자의 방안인 ‘격리유치장’은 헌법 제12조 제3항에 근거한 것이 아니라, 헌법 제37조 제2항의 ‘공공복리’에 근거하여 국민의 자유와 권리를 제한하는 것이므로 헌법상의 영장주의를 잠탈할 우려가 있는 반면, 구속기간의 불산입 내지 연장의 문제는 법률사항에 불과하므로 후자를 통하여 간명하게 해결할 수 있다는 점이다.
결국 헌법 및 형사소송법의 취지를 고려해 볼 때, 검사의 신청에 의하여 ‘감염병에 대한 완치 또는 미발병 사실 확정시까지’의 기간을 구속기간에 불산입하는 방안이 감염병 예방 및 관리에 관한 법률에 따라 제4군 감염병으로 분류된 메르스 등 감염 구속 피의자(이하 ‘감염 구속 피의자’라고 함)에 대한 구속기간의 개선방안으로 가장 합리적이라고 본다.
영문 초록
Constitution Article 12(3) has regulation about warrants system. Namely, Constitution Article 12(3) : Warrants issued by a judge through due procedures upon the request of a prosecutor shall be presented in case of arrest, detention, seizure or search: Provided, That in a case where a criminal suspect is an apprehended flagrante delicto, or where there is danger that a person suspected of committing a crime punishable by imprisonment of three years or more may escape or destroy evidence, investigative authorities may request an ex post facto warrant. Also, criminal procedure law Article 202(Detention Period by Senior Judicial Police Officer) and Article 203 (Detention Period by Prosecutor) has regulation about warrants period. Namely, Article 202 : Where a senior judicial police officer detains a criminal suspect, the suspect shall be released if he/she is not transferred to the prosecutor within ten days; Article 203 : If a prosecutor detains a criminal suspect or receives a suspect from a senior judicial police officer, the suspect shall be released if a public prosecution is not instituted within ten days. Especially, Article 205 has regulation about Extension of Detention Period which a judge of a district court may extend the period prescribed in Article 203, upon request of a prosecutor, and only one such extension shall be granted to the extent not exceeding ten days.
But, related to the spread of MERS which has occurred in the last year, if the accused may be designated as a infectious patients or quarantine-person by the state, significant problems on the investigation procedure can cause to suspects due to the elapsed period of detention because of the detention of long-term isolation, Therefore, Issue of the ‘isolated detention warrant’, or no-account of the detention period must be considered with the permission of the judge. The problem of ‘isolated detention warrant’ is not based on the Constitution, Article 12, paragraph 3, because that limits the freedom and rights of citizens on the basis of the Constitution, Article 37 paragraph(2) ‘public welfare’. So, constitutional warrant attention can be involved through invasion of the detention period, whereas no-account of the detention period which is only legal requirements can be resolved a problems on the investigation procedure.
Finally, the problem of ‘isolated detention warrant’ eventually seem to contrary to the constitution, so no-account of the detention period by the request of a prosecutor looks more reasonable to troubleshooting about a Detention period of the infected detention-Suspects on MERS and many other diseases which was classified to Group 4 infectious diseases according to INFECTIOUS DISEASE CONTROL AND PREVENTION ACT.
