국문 초록

소송사기에 의한 허위등기의 경우 또는 허위등기에 의한 소송사기의 경우 사기죄와 공정증서원본불실기재 및 동행사죄가 성립하고, 이 죄들은 상상적 경합에 해당한다고 본다. 소송사기와 허위등기 사이에 기능적 행위단일성이 인정되어 형법 40조가 말하는 ‘1개의 행위’로 볼 수 있기 때문이다. 소송사기에 의한 허위등기의 경우는 소송사기가 수단이고, 허위등기가 목적인 반면, 허위등기에 의한 소송사기의 경우는 거꾸로 허위등기가 수단이고, 소송사기가 목적이다. 이러한 논리에는 형법 40조의 ‘1 개의 행위’는 자연적 관점에서 파악한 구성요건적 실행행위의 동일성의 의미만 갖는것이 아니라 기능적 관점에서 파악한 기능적 행위단일성의 의미도 갖는다는 전제가 있다.

영문 초록

This article deals with debate on single or several crime and compound or concurrent crimes, in case of procedural fraud and false registration are functionally closely associated with each other. Fraud is crime which defrauds another person, thereby taking property or obtaining pecuniary advantage from another person. Another person is victim. In case of procedural fraud, not the victim but the court is the object of defrauding. The untrue entry in officially authenticated original deed(K.P.C. §228) is crime which makes a false report to a public official and has that official enter record any false fact in the authentic deed etc. In false registration, this crime is established. In case of procedural fraud and false registration are functionally closely associated with each other, fraud and the untrue entry in officially authenticated original deed are compound crimes or several crime by single act. This can be said that two of these offenses are related to the crimes charged as single crime.
