국문 초록

본 연구의 주요 목적은 피의자의 5가지 스트레스 반응상태들(분노, 우울, 부인, 협상, 수용)에 따른 키니식 면담과 관련한 Stan B. Walters의 기본 실용적 키니식 원칙들을 초점으로 리뷰하고 소개하는 데 있다. 각각의 5가지 스트레스 반응상태들을 분석하는 동안, 신문관은 피의자의 특정한 언어단서들(verbal cues)과 비언어증상들(nonverbal symptoms)을 토대로 그의 기만, 내적 인지적·정서적 반응, 이차적 신문공격 등을 식별할 수 있어야 한다. 이러한 실용적 키니식 신문단계는 수사면담관이 피의자들로부터 보다 정확한 정보를 수집할 수 있도록 조력할 것이다.이 스트레스 반응상태들의 인지와 이 기능들의 이해는 수사면담관이 피의자의 스트레스 자극에 관련한 현재의 심리반응(psychological response)을 결정할 수 있도록 조력한다. 각 반응상태를 인지할 수 있고 그 목적을 이해할 수 있으므로 수사면담관은 피의자의 노력에 반하여 무력화시키거나 그의 인정반응(acknowledgment response)을 이용할 수 있으며, 이로써 시인과 자백을 얻어낼 수 있다. 신문관은 실용적 키니식 신문기법을 사용함으로써 오심(miscarriages of justice)을 줄이고, 피해자의 권리를 보호하고, 피해자와 증인으로부터 완전하고 신뢰할 수 있는 정보를 수집하고, 피의자들로부터 신인과 자백을 전문적·윤리적·합법적으로 얻어낼 수 있다. 즉, 피의자도 자신이 기댈 수 있는 최소한의 자존심이 필요하다는 것과 신문관은 시인과 자백을 받아내기 위해 피의자를 완전히 파괴하지 말아야 한다. 국내 수사 및 신문 시에도 이러한 행동분석에 기반을 두고 있는 실용적 키니식 신문기법을 활용하여 피해자, 피의자, 증인 등으로부터 보다 전문적·윤리적·합법적으로 정보, 시인, 자백을 얻어낼 수 있어야 한다. 아울러 연구의 제한점과 추후 연구에 대한 방향을 제시하였다.

영문 초록

The main purpose of this study is to review and introduce Kinesic Interview of Subjects' Five Stress-Response States Focused on Stan B. Walters' Basic Practical Kinesic Principles. During the analysis phase of each of the five stress-response states, an interrogator must be able to identify a subject's deception, internal cognitive and emotional responses, and subsequent interrogation attack based on his specific verbal cues and nonverbal symptom. This practical kinesic interrogation phase will help an investigative interviewer establish information more accurately. The recognition of each of these stress-responses states and an understanding of their functions makes the investigative interviewer determine the subject's current psychological responses to the stress stimuli. By recognizing each state and understanding its purpose, the investigative interviewer can either disable his subject's effort at contradiction or capitalize on his acknowledgment response, thereby obtaining an admission or confession. The interrogator can reduce miscarriages of justice, prevent a victim's right, get the complete and credible information from subjects and witnesses, and gain admissions and confessions professionally, ethically, and legally from subjects by using the practical kinesic interrogation. Namely, the subject absolutely needs a little piece of self-esteem to lean on. Also the interrogator shouldn't entirely annihilate the subject in order to obtain the admission or confession. During the investigation and interrogation phase of Korea, Korean interrogators should be able to use the piratical kinesic interrogation based on behavioral analysis so as to gain information, admissions, and confessions more professionally, ethically, and legally from victims, subjects, and witnesses. The following implications and limitations of this study were discussed along with the suggestions for future studies as well.
