감사의 기능의 본질상 요청되는 감사원의 독립성과 독립성확보방안

국문 초록

과거와 현재 진행 중인 헌법 개정 논의 가운데 재정민주주의와 관련하여 의 국회의 이관여부와 관련하여 국회의 결산기능의 강화를 위한 감사원의 이관이 중요한 쟁점으로 부각되고 있다. 개헌과 관련하여 가장 많이 논의되고 있는 주제의 하나가 국회의 국정통제기능 활성화이며 이와 관련하여 국회의 회기제를 폐지하고 상설화하는 방안, 예산결산위원회를 상임위로 하는 방안, 상시적인 국정조사를 전제로 국정감사를 폐지하는 방안 등이 주장되고 있는데 이와 같은 국회의 국정통제기능 활성화 내지 강화를 위해서는 국회산하에 전문적인 회계검사기관에 의한 뒷받침이 필요하다는 점이 강조되고 있다. 이와 관련하여 감사원의 귀속은 헌법에 규정되어 있기에 이에 대한 헌법적 검토를 하고 향후 헌법개정이전이라도 재정민주주의를 위한 국회와의 감사원의 협력방안을 마련하기 위하여 이 논문을 작성하여 보았다. 특히 독립기관으로의 이전, 국회로의 이전 이나 현재의 대통령소속의 현행체제를 유지시에 지켜야 할 보장방안 에 대해서도 구체적으로 검토하였다. 기존의 논의는 감사원의 소속을 중심으로 비교법적이고 단순한 제도론적 논의를 기준으로 형식적인 관점에서 검토하고 있다. 하지만 논의의 출발점은 감사원의 기능의 본질을 중심으로 한 실질적 검토가 중심이 되어야 한다고 보인다. 즉 이 문제는 오늘날 국민주권 하에서의 국민의 권리를 보호하기 위한 목적 하에서 감사원의 이전여부를 논의하여야 하는데 단지 비교법적인 측면에서 논의를 하는 것 같아서 감사원의 직무의 성질과 관련하여 실질적 논의를 진행하였다. 이러한 논의의 핵심은 감사원의 기능상의 문제점을 소속 상의 이전을 통해서 해결하는 것이 타당한지 아니면 오히려 감사원의 기능을 실질 화하여 기능상 독립 을 이룰 것인지에 대해서 검토 할 필요가 있는데 이 논문은 후자의 입장이 감사의 본질상 타당하다는 결론에 도달하였다.

영문 초록

Among the discussion of constitutional amendments relating to fiscal democracy under process, to strengthen National Assembly’ settlement of account function, relocation of budget organization and the Board of Audit and Inspection from administration to National Assembly have emerged as an important issue. Relation to constitutional amendment the point of the most talked about main subject is national Assembly’ function of controling government administration. Specially to invigorate or consolidate function of controling government administration, relocation 0f the Board of Audit and Inspection, professional Accounting inspection agency, under the National Assembly, is necessary. To control government administration, instead of strengthening authority of national assembly independence of the Board of Audit and Inspection especially, independence from the president, is, most of all, necessary in my opinion. namely, since belonging of the Board of Audit and Inspection is ruled by constitution, instead of relocating 0f the Board of Audit and Inspection, professional Accounting inspection agency, under the National Assembly, in the point of constitutional review for fiscal democray, dependence of the Board of Audit and Inspection especially, independence from the president, is, most of all, necessary. in this point, instead of relocation 0f the Board of Audit and Inspection, professional Accounting inspection agency, under the National Assembly, to strengthen cooperation with National Assembly and the Board of Audit and Inspection necessary. Existing discussion of constitutional amendments relating to fiscal democracy, the rerocation of Board of Audit and Inspection is going in the point of formal comparative law and institutional theory. But, in my opinion, to solve problem of function of Board of Audit and Inspection instead of relocating 0f the Board of Audit and Inspection, professional Accounting inspection agency, under the National Assembly, strengthening functional independence of Board of Audit and Inspection is the best and right way.
