영문 초록

Even though it falls 'a trademark consisting solely of a conspicuous geographical name, the abbreviation thereof or a map', a trademark recognized remarkably among consumers whose goods it indicates in connection with his business as a result of using the trademark before the application for trademark registration may be registered with any goods using the trademark as designated goods. This is to protect the credibility of the trademark and the trust of consumers. However, even though a conspicuous geographical name may be registered, the scope of its right is limited by article 51(3)3. That is, no effect of trademark right shall be extended to the trademark which falls under a trademark formed of distinguished geographical denomination and abbreviation thereof or map. Therefore, it is reasonable to have questions regarding the scope of a registered trademark consisting of a conspicuous geographical name. Without the right to limit other's use of the registered trademark, there is no meaning to apply, be examined and register such a trademark. On the other hand, if we should understand that article 51 may not be applied to the registered trademark after a conspicuous geographical name is registered, we have no legitimate ground for such understanding, because article 51 obviously limits the scope of trademark right. Thus, the purpose of this article is to examine whether understanding that article 51 may be applied to the registered trademark consisting of a conspicuous geographical name is appropriate or not, and to provide a suggestion to revise the relevant article.
