보스니아 난민 문제 현황과 난민 정책에 관한 연구

국문 초록

20세기 이후 들어와 국제 사회의 여러 곳에는 내전과 정치적 불안 그리고 경제적 어려움 등 다양한 요인에 따른 난민 문제 발생이 빈번해 지고 있는 게 현실이다. 더불어, 현재 한반도 지역을 비롯해 대량 난민 문제가 발생할 소지가 높은 지역들 또한 계속해서 급증하고 있는 상태라 할 수 있다. 이러한 연구 배경을 바탕으로, 본 논문에선 보스니아를 주요 사례로 선택해 발칸유럽에서 발생한 대량 난민의 발생 배경과 난민 문제 해결을 위한 국제법적 정당성을 살펴보고, 이를 기초로 UNHCR와 EU 등 국제사회가 선택한 대응 전략은 무엇이었고, 그 실효성은 어떠했는지를 분석하고자 한다. 1989년 동유럽의 민주화 이후 보다 많은 민족 문제와 다양한 민족갈등이 촉발되고 있는 발칸유럽의 여러 국가들 중, 본 논문의 주요 사례로 선택한 보스니아는 1992년 3월부터 시작된 약 3년 8개월간의 장기간 내전으로 인해 대량 인종 학살과 대규모 난민 문제를 직접 경험한 지역이라 할 수 있다. 내용을 살펴보면, 본 논문에선 우선 보스니아에서의 난민 발생 배경을 사회주의 유고 연방 붕괴와 이후 발생된 내전의 확대에서 비롯되었음을 설명하고, 그 내용과 전개 과정에 대해 소개하고자 한다. 그리고 보스니아 난민 문제 해결을 위한 국제 사회의 개입 및 국제법적 정당성을 내전 종결을 위한 ‘데이턴 합의안’의 내용과 UNHCR 개입 및 난민 구호 정당성에서 찾고자 한다. 이와 함께, 유고지역 및 보스니아 난민 문제 해결을 위한 국제 사회의 대응 전략 취지와 전반적 내용을 UNHCR의 ‘임시 보호(Temporary Protection) 정책’ 수립과 이에 대한 EU의 공조 및 정책 적용을 통해 분석하고자 한다.

영문 초록

In this paper, the historical backgrounds of refugee populations and the legitimacy of international law as a resolution for the refugee problem is studied with focus on Bosnia. Subsequently, the corresponding strategies employed by international organizations such as the UN and UNHCR are analyzed to determine their practicality and efficacy. Countries in Eastern Europe have experienced various national problems and conflicts with the advent of democratization and liberalization beginning in 1989. For this study, Bosnia was selected among the countries of Eastern Europe due to its relatively recent experiences involving mass ethnic massacres for example, and the exploding refugee problem that occurred as a result of the civil war which lasted 3 years and 8 months(ending in March 1992). The structure of this paper is as follows: First, in the Chapter II, the historical background of refugee situation in Bosnia is explained in terms of it originating from the collapse of the Federation of Socialist Yugoslavia. The subsequent civil war is discussed as is the progression of the conflict. In the Chapter III, the legitimacy of international law as a resolution for the refugee problem in Bosnia is analyzed, with specific reference to the Dayton Agreement, which brought about the end of the civil war. The intervention of the UNHCR for the refugee relief is also examined. In Chapter IV, the correspond strategies of international organizations as solutions to the refugee problem in Bosnia is discussed in terms of the Temporary Protection Policy of the UNHCR. Moreover, mutual assistance efforts and application of policies between the UNHCR and EU are investigated.
